MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, OCTOBER 14, 1968 AT 8:00 P. M.

The meeting was called to order by the Mayor-Commissioner, Mr.
Howell.
The Invocation was given by Commissioner Rosborough.
Minutes of the meeting of September 23, 1968 were approved as
written upon motion of Mr. Longo, seconded by Mr. Rosborough and
carried.
Mayor Howell recognized visitors present and called for any busi-
ness from the floor not on the Agenda. There was none.
Mr. Vogel reported that we are trying to get parts for the
Comminutor from the manufacturer and make necessary repairs to
the one we have. He therefore did not call for bids.
Mr. Vogel advised that Burkhalter Wrecking Company has completed
the work contracted for. The City Clerk advised she will need
a Resolution to set up lien book on this. Mr. Ball will prepare
necessary Resolution for next meeting.
An Ordinance was presented in full in writing to rezone approxi-
mately 12 acres lying between the water plant and the lagoon and
between 11th Street and Selva Marina Country Club, for passage
on first reading by title only. Mr. Howell explained that if it
is passed on first reading that does not mean it is finally
adopted but only that it is approved for consideration, and a
Public Hearing will be set for one month later for consideration
on second and final reading. Since there are those present
because of their interest in the matter, Mr. Howell advised that
with Commission' s consent he is going to deviate from usual
procedure and allow discussion at this meeting, too. Mr.
Rosborough moved adoption of said Ordinance on first reading by
title only, seconded by Mr. Holloway. Mr. Howell stated that
Mr. George Bull had requested permission to speak. Mr. Bull
presented concisely and in detail their proposal to develop this
area by building 206 garden type apartments to be done in two
stages. The matter was thoroughly discussed. Among those speak-
ing were Mrs. P. H. Campbell, Louis Macdonell, Jim Campbell,
David W. Cole, Richard J. Collins, Frederick Aldridge, Mr. and
Mrs. H. R. Jackson, James U. Moorhead, Frank Garcia, S . C. Granger,

George Cunningham, Robert B. Whyte, Joseph V. Tierney, and others.
Some were not particularly opposed to project but were concerned
over overtaxing city utilities. Others were opposed to project
because of causing more traffic congestion, overcrowding Atlantic-
Neptune School, decreasing their property values, fact that they
understood nothing but single family houses would be allowed in
that area, would depreciate value of present homes, would inter-
fere with the peace and tranquility of our home community, and
concern over those drawn to this type of project. After this
discussion Mr. Howell declared Public Hearing for this meeting
closed, and again explained if this Ordinance should pass on first
reading, there would still be a second and final reading with Public
Hearing. After further discussion by the Commissioners, the
question was called and the vote was:
Aye : None
Nay: Holloway, Longo, Rosborough, Weldon
Pass : Howell
Whereupon Mayor Howell declared the motion failed to pass and
Ordinance was not adopted on first reading.
Request was made for approval to purchase on P. 0. #5054 from
Account #1501 goosenecks, saddles, etc. in the amount of $147 . 54.
Mr. Longo moved approval as requested, seconded by Mr. Rosborough
and carried.
The Public Works report for September 23 through October 11, 1968
was presented for information. Mr. Weldon inquired as to Item 5.
Mr. Hilliard advised they were working to correct the bad drainage
situation on W. 10th and W. 11th Streets improperly done when
Mayport Road was improved. He stated we were stopped by the State
Maintenance Inspector as we had not presented proper papers to
State Road Department before starting work. He is in process of
getting proper papers together for their approval.
Police Department report for September, 1968, together with copies
of Municipal Court dockets for September 23rd, 30th and October 7th,
1968, were presented for information and filing.
Mr. Vogel requested approval to have two street lights installed,
one on Belvedere Street and one on Plaza. Mr. Weldon moved approval
of installation of two street lights at locations as requested,
seconded by Mr. Longo and carried.
Mr. Vogel requested that City Attorney be directed to prepare an
Ordinance for consideration changing our requirements on lintels,
as he does not think a poured lintel is necessary. Mr. Ball was
asked to prepare Ordinance for consideration.
Mr. Vogel requested approval to pay Mr. Hilliard' s expenses to
Southern Building Congress at New Orleans from Commissioner ' s
Account #216. Mr. Weldon moved approval, seconded by Mr. Longo
and carried.

Mr. Vogel complimented the City Clerk 's staff on getting out the
tax statements and utilities bills by October 1st.
Mrs. Grage advised that Mr. Whittlesey has requested return of
the two copies of the landfill contract on which action was deferred
at last meeting. This is now a part of the City of Jacksonville
Health Department as of October 1st. She was directed to return
the contract as requested to Mr. Whittlesey.
Mr. Weldon asked as to the alterations being made at the Police and
Fire Station for a Courtroom and stated he was upset that it is
being done without action of the Commission; such action should not
have been taken by City Manager without submitting to Commission.
Mr. Vogel stated he had included this work in the Budget and it was
his intention at that time to advise the Commission. Chief Stucki
advised he understood the money was in Budget for remodeling and
they were acting under City Manager Vogel with concurrence of the
Municipal Judges as the City Hall is crowded for Court on Mondays,
parking is inadequate and records which are often needed are at
Police Station. Mr. Weldon advised he appreciates remarks but feels
the City Manager overstepped his authority by not submitting to
Commission for approval and he would ask that formal action be
taken before Courtroom is moved to Police Station. Mr. Rosborough
agrees with Mr. Weldon that Commission should approve. There was
further discussion following which Mr. Rosborough moved that the
improvements be discontinued as of now and a meeting be called with
City Commission, the Municipal Judges, Police Chief and City
Manager to discuss, seconded by Mr. Weldon. The question was called
and the vote was :
Aye: Rosborough, Weldon, Holloway
Nay: Longo, Howell
Whereupon the Mayor declared the motion carried.
Mr. Weldon requested that the City Manager submit a written monthly
report in line with Rule 20 of Ordinance *5-57-1.
Mr. Weldon moved that a Resolution be prepared for the City Manager
and City Attorney to write the City of Jacksonville Attorney with
copies to Jacksonville Library Board of Trustees, the Jacksonville
Planning Board, and other interested parties, requesting construc-
tion of a branch library for this area on Atlantic Boulevard,
seconded by Mr. Longo and carried.
Mr. Rosborough advised that Mr. Ed Holtsinger has been appointed
Director of Marketing for Electric Authority of the City of
Jacksonville, and he will contact us on franchise. Mr. Howell
asked Mr. Rosborough to follow through on this.

Mr. Howell advised that former Commissioner Wo Laney Whitehurst
had recently losthiswife. Mrs. Grage was asked to mail him
a card from the City.
There being no further business,. the Mayor declared the meeting
adjourned.
