MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, AUGUST 26, 1968 AT 8:00 F . M.
Present:
William S. Howell, Mayor-Commissioner

The meeting was called to order by the Mayor-Commissioner,
Mr. Howell.
The Invocation was given by Commissioner Holloway.
Minutes of the meeting of August 12 , 1968 were approved as
written upon motion of Mr. Longo, seconded by Mr. Holloway
and carried.
Mayor Howell recognized visitors present and called for any
business from the floor not on the agenda. There was none.
Mayor Howell then presented Ordinance #60-68-3 being an ordi-
nance amending Sign Ordinance #60-65-1, Section 8, and read
same in full. Said Ordinance has been posted in line with
Charter requirements. The Mayor then opened the meeting for
Public Hearing on Ordinance #60-68-3. Mr. Alan Fotter, member
of the Ilanning Board that drew up and recommended the original
sign ordinance spoke against the amending ordinance. He
questioned the necessity for waiving the rules for passage on
1st reading, and minutes do not reflect which citizens requested
amending the ordinance for continuing such signs andthere are
no people in Atlantic Beach in sign business and no sign business
located in Atlantic Beach. He advised other members of Ilanning
Board could not be present but endorse the position he is taking.
Mayor Howell advised that he is not opposed to the sign Ordi-
nance but feels there are parts of it that need amending. He
has not changed his view point as stated on page 5 of the minutes
11/ of meeting of Aril 11, 1966. There was a lengthy discussion
following which the Mayor declared the Iublic Hearing closed.
Mr.Longo moved passage of Ordinance on 2nd and final reading,
seconded by Mr. Howell and after further discussion the Mayor
put the question and the call vote was :

Whereupon the Mayor declared the motion carried and Ordinance
#60-68-3 passed on 2nd and final reading.
Mr. Howell next presented for 2nd and final reading Ordinance
#20-68-17 and read same in full. Said Ordinance amending
1968 Budget Ordinance by providing for full payment on garbage
truck and was posted as required by Charter. Mr. Howell then
declared the meeting in session for lublic Hearing. Mr. Good-
ling asked just for information as to the reason for Ordinance
and was advised it provides for receiving and disbursing the
money borrowed from First National Beach Bank in order to take
advantage of the cash discount offered by dealers . As no one
else appeared for or against the Ordinance, the lublic Hearing
was closed. Mr. Longo moved passage of Ordinance #20-68-17
on 2nd and final reading, seconded by Mr. Howell and carried.
Mr. Howell next presented Ordinance #50-68-7 amending lersonnel
11/ Ordinance #50.-66-6, Section 1 covering salary schedule and
read same in full. Said Ordinance #50-68-7 was posted in line
with requirements of the Charter. Mayor Howell then declared
the meeting in session for lublic Hearing on said Ordinance.
Mr. Don Goodling advised he was not against ordinance and
schedule for employees but asked if all the employees were
getting salaries within the schedule, and was advised they were.
He questioned banning ceiling on wages as covered by Class 'A"
but it was advised that Section 1-A of the Ordinance 50-66-6
was not amended or repealed and it provides for across the
board increases or decreases for positions classified in Section
1. He advised he is convinced the lolice latrolmen are under-
paid and feels the top grade should be higher. As no one else
appeared either for or against the Ordinance the Mayor declared
the lublic Hearing closed. Mr. Longo then moved passage of
Ordinance #50-68-7 on 2nd and final reading, seconded by Mr.
Holloway and carried.
In regard to Mrs . Florence Donaldson's application for water
in North Atlantic Beach, Mr. Vogel reported he had discussed
with Mr. larks the matter of number of services on a 2`° line.
He advises the present 2" line in North Atlantic Beach already
has more than capacity services and he would not recommend
any further connections. Mr. Holloway, therefore moved that
Mrs. Donaldson' s application be denied, seconded by Mr. Longo
and carried.

As to Mr. C. E. Powell 's request to Mr. Rosborough relative to
a $2500.00 sewer escrow, Mr. Vogel advised he had investigated
and the City Clerk had copies of Receipt #639 to Pepo Petroleum
Company in the amount of $2250.00 to cover '`cost of extending
Sewer line across Mayport Road to serve Lots 1 and 2, Block 39,
Section H, 880 Mayport Road" , and of two checks - one in the
amount of $356.29 to Walter J. Parks , Jr. to engineer work on
this project and the other to trt Reinertson Construction Co.
in amount of $3562.87. $1893. 71 of this was for this extension
across Mayport Road to the Fepo Station at West 8th St. and
Mayport Road. These were all dated in 1962 and }epo Petroleum
Company has been paying sewer service charges since that time.
Mr. Vogel reported that at a meeting with the Expressway Author-
ity representatives it was agreed that they would install lights
on Mayport Road overpass , if Cities of Atlantic Beach and Nep-
tune Beach would maintain and pay for current an their respective
sides. The matter was discussed and it was agreed that we
would maintain and pay for current for those on north side of
the overpass. Mr. Holloway therefore moved passage of Resolution
#68-25 stipulating that we would so do, seconded by Mr. Longo
and carried. Copy of Resolution #68-25 is attached hereto and
made a part hereof. Copies of Resolution to be sent to interest-
ed parties .
Mr. Vogel advised that Mr. C. H. Wilkerson would like to dedicate
two alleys in his plat in Lot 15, Donners Subdivision to the
City. In the discussion Mr. Howell suggested he deed it to the
Public , in which case the City would not have responsibility
of upkeep. Mr. Vogel will so advise Mr. Wilkerson.
Mr. Vogel advised that Mrs . Vivian Stuart has given approval
for removal of the bus stop shed from her property. He then
advised that they have agreed to tear down the old Louie's Bar
building but in so doing have found that three walls are in
very good condition and would like permission not to tear them
down as they want to use them in building a new building. Mr.
Bob Ulbrick speaking for Mrs . Stuart advised he is unprepared
with plans for the new building to-night but would like an
extension of time to the next commission meeting to bring in
plans for permit. It was consensus to allow this time extension
as requested.
Mrs . Grage advised that from 1964 through 1957 we have carried
on our tax rolls a house on the east 75 ' of property recorded
in DB 1355-136, Donners Replat and on investigation by the
County and the City it is determined there is no house there
and there has not been one. The County has never shown a house

on this property. Mrs. Grage requested approval to correct the
Tax Rolls for those years by removing the house and waive the
tax thereon in amount of $104.21. Mr. Holloway moved approval
as requested, seconded by Mr. Longo and carried.
Mrs. Grage advised that for the years 1952 through 1957 our
tax roll lists a part of Govt. Lot 2, part of Lot 7, Donners
Subdivision as belonging to Rosa Mae Williams . The County
lists this part of Lot 7 Donners Subdivision as being part of
land belonging to Charles Williams , Sr. and exempted as part
of his homestead for these years . A search of records fails
to show any deed on change of ownership of this plot from
Charles Williams , Sr. and our listing appears in error. Mrs.
Grage requests approval to remove this listing from Tax Rolls
for those years and waive the taxes as they should have been
part of exempt land. Mr. Holloway moved approval as requested,
seconded by Mr. Longo and carried.
Mr. Vogel presented twelve Resolutions #68-13 through #68-24
ordering removal of condemned houses ,etc . , on which proper
notices have been sent. Descriptions are in copies of said
Resolutions which are attached to these minutes and made a
part thereof. The matter was discussed following which Mr.
Longo moved adoption of Resolutions as presented and authori-
zation to Mr. Vogel, as requested by him to call for bids
covering the work with amounts shown on each parcel affected,
seconded by Mr. Holloway and carried.
Municipal Court dockets for August 12th and 19th, 1968 were
received for information and filing.
Mr. Longo requests that Sherry Drive be yellow striped before
school opening.
Mr. Holloway stated he would like to know, as budget will be
prepared shortly, what steps we have taken to initiate a
program on how our Citizens will be taxed the coming year,
as to whether we are going to pay for our Folice and Fire
protection or whether the consolidated government is going to
pay for it. He thinks Atlantic Beach should c1.o it on their own
and find this out, and our representative should bring inform-
ation back to us. He would like a written report by next
11/ meeting. Mr. Vogel advised he has been endeavoring to get with
some of the consolidated government personnel but hasn't
succeeded so far. There was further discussion and Mr. Vogel
advised he would have report at next meeting. Mr. Long asked
to be included with Mr. Vogel in making this study, and Mr.

Holloway stated he felt Acting City Attorney should be included.
Mr. Vogel requested approval to purchase 12 water meters at
approximately $35.00 each and also pipe and accessories to in-
stall water line to improve pressure on Fark Terrace East and
West and Club Drive for an estimated cost of $300.00 from
account 1501. Mr. Holloway moved approval of purchases as
requested, seconded by Mr. Longo and carried.
There being no further business Mayor Howell declared the
meeting adjourned.

A RESOLUTION LEVYING AND IMPOSING SPECIAL CONDITIONS
FOR THE REMOVAL, SUPPRESSION OR ABATEMENT OF A DANGEROUS
UNSAFE, DILAPIDATED OR UNSANITARY STRUCTURE, PURSUANT TO
THE PROVISIONS OF ORDINANCE NO. 25-67-6 OF THE CITY OF
ATLANTIC BEACH, FLORIDA, AGAINST THAT CERTAIN PROPERTY
THAT IS HEREBY DECLARED TO BE A PUBLIC NUISANCE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH,
FLORIDA,
SECTION 1. It is hereby ascertained, determined and declared that
the certain structure, occurrence or condition upon that certain
property described as:

Lot E 100 ' of Lot 5 Block
Known as 1950 Park Street, atlantic Peach, Fla.

SECTION 2 . That the aforesaid conditions constitute a public
nuisance.
SECTION 3 . The City Manager, or his duly authorized agent, is
hereby ordered to:
Remove remains of burned out house and restore lot to original
condition.
SECTION 4. The City Manager, or his duly authorized agent, shall
cause a true copy of this Resolution to be posted upon the premises
and a true copy delivered or mailed to the owner and interested
parties.
SECTION 5. This Resolution shall take effect immediately upon its
passage.

RESOLUTION #68-25
WHEREAS, the City Commission of the City of Atlantic
Beach, Florida, in adopting the 1968 Budget, provided
funds for the operation and maintenance of street
lights, and
WHEREAS, The Jacksonville Expressway Authority will
install street lights on the Atlantic Boulevard and
Mayport Road Overpass,
NOW THEREFORE BE IT RESQLVEA THAT the City cf Atlantic
Beach will assume the cost of operation and maintenance
of said street lights on the South side of said Over-
pass.
