MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISSION

The meeting was called to order by the Mayor-Commissioner, Mr.
Howell.
The Invocation was given by Commissioner Weldon.
The minutes of the meeting of May 27, 1968 were approved as
written upon motion of Mr. Longo, seconded by Mr. Holloway and
carried.
Mayor Howell recognized visitors present and called for any busi-
ness from the floor not on the Agenda.
Mr. Frank DeBow advised he had received the condemnation notice
on their property and advised they are going to tear it down.
He also asked as to why they had received lot cleaning notice on
their lots. It was advised that we don't have any of the Section
H lots on lot cleaning except where there has been a complaint
and situation warrants. City Manager to look into.
Mr. W. M. Sandberg advised that on their property which was con-
demned that it was a bad investment and they agree to condition
and will tear down, but would appreciate it if they could have 90
days to do the work. It was agreed to allow them the 90 days.
The bids on water tank were next considered and the report of the
Committee presented. Copy of the report is attached to these
minutes and made a part hereof. Mr. Holloway moved that the
recommendations of the Committee to accept the bid of Sieg and
Ambachtcheer, Incorporated, for $1, 100.00, be accepted as the
lowest and best bid, seconded by Mr. Longo and carried.
Mr. Longo reported that the Commission had an open Committee
session and they plan to have a Personnel Ordinance ready for
consideration in the very near future.
Mr. Rosborough reported on Atlantic Boulevard lighting that he
had met with representatives of the City of Jacksonville Electric
Department, and Neptune Beach, to coordinate the project. The
Committee recommends that we have 53 lights on north side of
Atlantic Boulevard to the Canal, which will mean 48 new 400 Watt
luminators, and we presently have 5 - these will go to the Canal.
On Mayport Road there will be a total of 48 lights - we presently

have 23,E and they will have to install 15 new poles. These
lights will go to Church Road. The cost will be $6.00 per light
per month, which will include current and maintenance. It will
be necessary to enter into a 2 year contract to cover, and
Committee recommends that we enter into such agreement.
Mr. Holloway moved we accept recommendations of the Committee
and that it be paid from Account 1011, and that the contract be
signed by the Mayor subject to approval of same by the City
Attorney, seconded by Mr. Weldon. There was a discussion during
which it was brought out that we will have a total of 101 lights,
53 on Atlantic Boulevard and 48 divided between east and west
sides of Mayport Road. Also that the City of Jacksonville
Engineers advise they can get to work on it in a week. It was
brought out in the discussion that our Charter specifically states
where our west boundary is and it can be definitely determined.
Following discussion the Mayor put the question and the motion
carried.
Mr. Vogel reported he and Mr. Walter J. Parks, Jr. have submitted
our application on the sewage treatment facilities.
Mr. Howell presented invoice from Mr. Parks for engineering fees
in amount of $5,400.00 which is 11/2% of estimated cost of construc-
tion, which is in line with our original agreement with him.
This covers preparing and submitting subject sewer report in 12
copies. Mr. Weldon moved payment of bill from Account 2054,
seconded by Mr. Longo and carried.
Mr. Howell presented an Ordinance in full in writing for first
reading by Title only, said Ordinance providing that "IT IS
UNLAWFUL TO KNOWINGLY EXHIBIT TO A MINOR OR TO SELL TO A MINOR
AN ADMISSION TICKET TO OR PASS TO OR ADMIT A MINOR TO, OR FOR
A MINOR TO VIEW A MOTION PICTURE, SHOW, OR OTHER PRESENTATION,
OR TO SELL OR LOAN TO A MINOR FOR MONETARY CONSIDERATION, OR FOR
A MINOR TO PURCHASE OR POSSESS, ANY PICTURE, PHOTOGRAPH, DRAWING,
SCULPTURE, BOOK, PAMPHLET, MAGAZINE, PRINTED MATTER, OR SOUND
RECORDING WHICH IN WHOLE OR IN PART DEPICTS NUDITY, SEXUAL
CONDUCT OR SADO-MASOCHISTIC ABUSE AND WHICH, TAKEN AS A WHOLE
IS PATENTLY OFFENSIVE BECAUSE IT AFFRONTS PREVAILING STANDARDS
IN THE ADULT COMMUNITY AS A WHOLE AS TO WHAT IS SUITABLE MATERIAL
FOR MINORS, AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF. "
Mr. Ed Calloway, Jacksonville Journal representative, questioned
who was going to decide what was or was not art or pornography.
Mr. Longo moved passage on first reading by Title only, seconded
by Mr. Holloway. There was further discussion, Mr. Calloway
questioning other points. Mr. Howell advised there will be a
Public Hearing on same and he is sure will be more fully
discussed. The question was called and the motion carried.
June 24th, 1968 at 8 :00 P. M. was set as date for Public Hearing
on said Ordinance.

Fire and Police Department reports for month of May, 1968 were
received for information and filing. Municipal Dockets for May
27th and June 3rd, 1968 were received for study and filing.
Mr. Vogel advised he had received a proposal from Municipal Code
Corporation covering codifying of City Ordinances. He wanted to
present it for study by the Commission. Mr. Howell suggested he
make copies and send to the Commissioners for their study and
consideration at next meeting.
Mr. Weldon advised that he is concerned over complete lack of
information the Commission has as to what is going on in the City.
He would like to request the City Manager give a report on major
activities at each meeting as to just what is going on and what
maintenance forces are doing, and he so moved, seconded by Mr.
Holloway and carried.
Mr. Weldon also advised he went down to the Beach at 5:15 P. M.
Sunday afternoon and there were approximately 100 people in sight
but no Life Guard. Chief Stucki advised they were on duty from
9:00 A. M. to 5:00 P. M. Mr. Weldon stated Jacksonville Beach,
Neptune Beach and North Atlantic Beach have them on until 6 :00 P. M. ,
and asked why we were different. Chief Stucki stated that was hours
we set. Mr. Weldon feels should coordinate with other Beaches and
that we should stay on until 6;00 P. M. , especially on Saturday
and Sunday. Chief Stucki will take care of the matter.
Mr. Weldon requested the City Manager to put signs at our City
limits on Mayport Road and Atlantic Boulevard. It was advised
we were waiting for construction on these roads to be completed,
as they have torn down the ones we had there. There was further
discussion as to City limits and our jurisdiction over roads. We
do have a reciprocal agreement with the other Beaches and the
County on traffic situations and fires.
Mr. Longo inquired as to Mosquito Control and when fogging starts.
This comes under jurisdiction of the East Duval County Mosquito
Control District.
Mr. Rosborough advised that there has been some dumped
on edge of Mr. Charles T . Tinsley' s yard at 305 Country Club Lane
and they would appreciate it being cleaned off as it is killing
the grass. Mr. Vogel advised he will get men up there and take
care of it.
Mr. Longo inquired as to when we can get all the palm fronds picked
up. Tropical storm "Abby" really blew them down - but we have two
garbage trucks and a flat bed on this pick up job and hope to have
all picked up soon.
Mr. Howell advised that Mr. Rosborough has agreed to represent the
City on new Board of the G.J.E.O. , and that he therefore is
appointing him as our official representative.

A letter was presented from the Jacksonville Beaches Jaycees
relative to an exhibition football game they are sponsoring at
the Gator Bowl on August 23, 1968 between the Miami Dolphins and
the Boston Pirates. Mr. Vogel is to write them of our meeting
dates and we will be happy for them to appear and present any
additional information.
There being no further business, Mayor Howell declared the meet-
ing adjourned.

for painting the water tank, find the bid of Sieg
and Ambachtscheer, Incorporated, to be the lowest

awarded to this company.
