11-13-18 Order- Appeal Hearing- Dally and ArmbrusterBEFORE THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH IN RE: Waiver Application WAIV18-0009 David Dally and Kathleen Armbruster 723 Sherry Drive ORDER CONFIRMING DENIAL OF WAIVER WAIV18-0009 This matter came to be heard upon the application for a waiver from Section 24-190 of the Land Development Regulations to allow for the division of the existing parcel at 723 Sherry Drive into two parcels by David Dally and Kathleen Armbruster, the owners of the property, on October 29, 2018. Section 24-190 provides that when more than one platted lot is combined and developed as a single development parcel, such lots shall not be later developed as a single lot, unless all requirements for development as a single lot are met. Having duly considered the application for waiver, supporting documents and comments by staff, the applicant, and members of the public at the public hearing on November 13, 2018, as well as the provisions of Section 24-191 regarding waivers from the provisions of Section 24-190, the City Commission of the City of Atlantic Beach hereby, FINDS AND DETERMINES: A. That the applicant did not demonstrate that an undue hardship due to unreasonable practical difficulties would result from compliance with Section 24-190, nor provided sufficient reasons and facts adequate to allow the City Commission to determine that the criteria set forth in Section 24-191(b)(1) through (4) were met.
