ORDER CONFIRMING DENIAL OF WAIVER WAIV18-0001
This matter came to be heard upon the application for a waiver from the Land Development
Regulations, Section 24-110, to allow a pawn shop in the Commercial Limited Zoning district at
1487 Mayport Road, #7 by Kelly Erhayel, the owner of the property, dated January 10, 2018.
Having duly considered the application for waiver, supporting documents and testimony
by staff, the applicant, and members of the public at the public hearing on January 22, 2018, as
well as the provisions of Section 24-46(d) of the Land Development Regulations regarding
waivers, the City Commission of the City of Atlantic Beach hereby,
FINDS AND DETERMINES:
A. The applicant did not demonstrate that compliance with Section 24-110 of the Land
Development Regulations would be unreasonable, in conflict with the public interest
or a practical impossibility, as set forth in Section 24-46(d).
B. The applicant did not establish a showing of good cause to allow the pawn shop in
accordance with Section 24-46(d).
NOW, THEREFORE, it is ORDERED by the City Commission:
1. The application for waiver is hereby DENIED.
Denied by the City Commission on January 22, 2018.
