MINUTES $� Regular City Commission Meeting Monday, June 24, 2019 - 6:30 PM Commission Chamber INVOCATION AND PLEDGE OF ALLEGIANCE Reverend Jessi Higginbotham from Community Presbyterian Church gave the invocation. CALL TO ORDER: Mayor Glasser called the meeting to order at 6:30 PM. City Clerk Bartle called the roll. Approve minutes of the Regular Commission Meeting on June 10, 2019 Mayor Glasser asked if there were any corrections or changes needed. There were no corrections to the minutes. Mayor Glasser stated the minutes stand as submitted. ACTION. • The minutes stand as submitted. 2 COURTESY OF FLOOR TO VISITORS 2A. Proclamation in Recognition of Bill Gulliford Mayor Glasser read the Proclamation recognizing Bill Gulliford. PUBLIC COMMENT Mayor Glasser explained the process for public comments and opened the Courtesy of the Floor to Visitors. City Clerk Bartle called each speaker to the podium. Regular City Commission June 24, 2019 Rocky Russell spoke against the new zoning proposals. John November spoke in favor of Johnston Island development plans. 3 CITY MANAGER REPORTS 3A. City Manager's Report CM Gerrity invited the Commission to a Workshop on July 8, 2019 at 5:30 PM (before the regular Commission Meeting). There have been two responses to the City's Branding Request for Proposal (RFP) and there will be a presentation. CM Gerrity announced Governor DeSantis approved the $300,000 appropriation for the Atlantic Beach Aquatic Drive stormwater project. 3B. Accept the 90 -Day Calendar (July through September 2019) Consensus was given to accept the 90 -Day Calendar, with the addition of the Workshop on July 8, 2019. 4 REPORTS AND/OR REQUESTS FROM CITY COMMISSIONERS Commissioner Norris • Spoke about her efforts on polling businesses on recycling issues. Commissioner Anderson • Reported on the Department of Transportation (DOT) meeting about traffic signals at Third Street and Atlantic Boulevard, stating there was a good turnout. • Spoke about the Sea Level Rise meeting and thanked Mayor Glasser. • Stated she attended the League of Cities dinner meeting in Clay County. • Spoke about the sidewalk project on Seminole Road. Commissioner Kelly • Thanked City staff for their work on the reception for Bill Gulliford, stating that it was a very elegant and friendly party. Mayor Glasser • Spoke about the two summer interns the City hired to assist with the Summer Camp at the Baker Center. • Spoke about single -use plastics and placing this topic on an agenda for open discussion. • Acknowledged the lifeguard rescue this past weekend and thanked them for their service. 5 UNFINISHED BUSINESS FROM PREVIOUS MEETINGS None 6 CONSENT AGENDA None Regular City Commission June 24, 2019 WA COMMITTEE REPORTS None ACTION ON RESOLUTIONS 8A. RESOLUTION NO. 19-35 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AUTHORIZING THE POLICE DEPARTMENT TO PURCHASE A RADIO CONSOLE DURING THE 2018-2019 FISCAL YEAR. Mayor Glasser read the Resolution by title. Chief Cook addressed the Commission about the necessity for a backup radio console as detailed in the Staff Report of the agenda. All questions were answered. MOTION: To adopt Resolution No. 19-35 as read. Chief Cook addressed the Commission about the 2018-2019 Justice Assistance Grant Program, as detailed in the Staff Report of the agenda. All questions were answered. CM Gerrity reviewed the bid process as detailed in the Staff Report of the agenda. All questions were answered. MOTION: To adopt Resolution No. 19-37 as read. ACTION ON ORDINANCES 9A. ORDINANCE NO. 90-19-241, Public Hearing and Final Reading AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, COUNTY OF DUVAL, STATE OF FLORIDA, AMENDING THE FUTURE LAND USE MAP OF THE 2030 COMPREHENSIVE PLAN TO CHANGE THE DESIGNATIONS OF CERTAIN PORTIONS OF "JOHNSTON ISLAND" FROM COMMERCIAL (CM) AND RESIDENTIAL LOW DENSITY (RL) TO RECREATION/OPEN SPACE (R/O) AND FROM RESIDENTIAL LOW DENSITY (RL) TO COMMERCIAL (CM); PROVIDING FINDINGS OF FACT; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. Mayor Glasser read the Ordinance by title. Regular City Commission June 24, 2019 Planning and Community Development Director (PCDD) Shane Corbin gave a presentation on the site history and the proposed amendment on the Future Land Development Map (FLUM) and Planned Unit Development (PUD). PCDD Corbin addressed the concerns about noise, light, wastewater, and landscaping. The applicant, Zack Miller, addressed the Commission and stated there will be one fuel pump as per code. Mayor Glasser opened the Public Hearing. There were no speakers and the Public Hearing was closed. A brief discussion ensued about the public green space, access hours, fencing, and lighting. Mr. Miller answered all questions. Commissioner Waters spoke about the proposed development being acceptable and desirable to the public. It will be open for public use, drawing interest to public waterways and parks, and will benefit Atlantic Beach without requiring any City funding. Commissioner Anderson spoke in support of the proposed development, echoing the comments made by Mr. November and Commissioner Waters. Commissioner Kelly spoke in support of the proposed development, agreeing with Mr. November and Commissioner Waters. Mayor Glasser spoke in support of the proposed development. MOTION. Mayor Glasser read the Ordinance by title. PCDD Corbin introduced Amanda Askew, the new Planner with the City of Atlantic Beach and provided the history and process of the Land Development Regulations (LDR) Update. Allison Megrath, Kimley Horn, gave a presentation (tivhich is attached and made part of this Official Record as Attachment A) covering the definition of Land Development Regulations, explained the necessity to change them over time, the progress made to date, and an overview of the proposed changes. Mayor Glasser opened the Public Hearing. CC Bartle called: Rocky Russell spoke against the changes for rezoning lots. Patsy Wynn spoke about the Ordinance, graphics, and landscaping. There were no more speakers and Mayor Glasser closed the Public Hearing. Commissioner Norris inquired about the tel 'duplex' and 'townhouse' and if either one will be eliminated. CM Gerrity responded that, per the building code, a duplex does not have a 2 hour firewall (between the dwellings) and is generally owned by one person. A townhouse will have a 2 hour firewall (between the dwellings) and is owned fee simple by one person. Ms. Megrath stated there is no elimination of duplex and/or townhouse uses in the City. The regulations have been streamlined in Section 24-107 to make them applicable in that section to both duplexes and townhouses. Discussion ensued about 'Tiny' houses, 'Container' houses, definitions, zoning requirements and minimum square footage, short term rentals definitions, proposed changes to fees, landscape requirements, E -scooters parking, and street and roadway definitions. MOTION. To amend Ordinance No. 90-19-240 to leave Planning Department fees as they currently stand. Motion: Brittany Norris Second. No Second Regular City Commission June 24, 2019 Discussion ensued about including other proposed language changes in the motion. CA Durden responded that the Commission should provide direction to include specific language in the Ordinance for the second reading about the fees, stormwater, and/or any other items that may be discovered. Consensus was given to include the language for onsite storage for stoimwater and to add the fee schedule. MOTION.- To adopt Ordinance No. 90-19-240 as amended with stormwater retention and fee schedule language. Motion: Candace Kelly Second. Blythe Waters Discussion ensued commending the thoroughness of the work put into the LDR Update and the Commission extended their appreciation to everyone on the LDR Rewrite Team. The deadline is July 1, 2019. • Wished Happy Birthday to Joe Gerrity! 12 CLOSING COMMENTS BY CITY COMMISSIONERS AND CITY MANAGER Commissioner Waters • Spoke about the reception and tribute to Bill Gulliford. Commissioner Anderson • Spoke about public parking, public beach access, and including the Commission when making changes, i.e. recent changes made on Saturiba. Regular City Commission June 24, 2019 CM Gerrity responded stating that the topic of parking has been studied and discussed at length by staff. Mr. Gerrity reviewed the minutes from a December 3, 2018 Workshop wherein staff presented several options to the Commission on parking. Staff did not receive any specific directions by the Commission from that workshop. Parking has been and continues to be an issue that is not getting better. Mr. Gerrity addressed the recent changes on Saturiba stating that taking actions to provide public safety is the City's responsibility. Mayor Glasser • Spoke about the reception for Bill Gulliford and stated she is presenting the Proclamation to Mr. Gulliford at the Jacksonville City Council Meeting tomorrow. • Spoke about parking issues stating the City Manager and the Police Chief have the authority to take action to control parking in the City. 13 ADJOURNMENT There being no further discussion, Mayor Glasser declared the meeting adjourned at 9:08 PM.
