City Clerk Bartle called the roll. Approve minutes of the Regular Commission Meeting on August 12, 2019. 1B. Approve minutes of the Emergency Special -Called Meeting on September 2, 2019. Mayor Glasser asked if there were any corrections or changes needed. There were no corrections to the minutes. Mayor Glasser stated the minutes stand as submitted. Regular City Commission September 23, 2019 2 COURTESY OF FLOOR TO VISITORS Mayor Glasser read the Proclamation honoring City Manager Joe Gerrity, who will be retiring from Atlantic Beach on October 5, 2019. Mayor Glasser presented Mr. Gerrity with a flag flown over the US Capitol provided from Representative John Rutherford. CM Gerrity thanked the Commission and stated he has enjoyed his time with the City of Atlantic Beach. PUBLIC COMMENT Mayor Glasser explained the process for public comments and opened the Courtesy of the Floor to Visitors. City Clerk Bartle called each 1 speaker to the podium. John Stinson expressed his gratitude and thanked Joe Gerrity for his service to Atlantic Beach. 3 CITY MANAGER REPORTS 3A. City Manager's Report CM Gerrity spoke about the demolition planning at 198 Poinsettia - involving one unit of a duplex structure, with each unit owned separately. Staff has been working on this project for the past 3 to 4 months dealing with several difficulties - finding a willing contractor, liability issues, planning, and scheduling. Referring to last year's budget, CM Gerrity stated funds were allocated for the marquis sign at the Adele Grage Community Center, as shown on the displayed slide. The Recreation department staff are responsible for what is displayed on the marquis sign. CM Gerrity requested approval to proceed. There was CONSENSUS from Commission to proceed. 3B. Accept the 90 -Day Calendar ( October through December 2019) There was CONSENSUS to accept the 90 -Day calendar. 4 REPORTS AND/OR REQUESTS FROM CITY COMMISSIONERS 5 UNFINISHED BUSINESS FROM PREVIOUS MEETINGS 5A. Annual Performance Evaluations of Charter Officers (Mayor Glasser) Mayor Glasser explained this is an obligation of the Commission to evaluate Charter Officers annually and proceeded with a request for an oral affirmation. Mayor Glasser asked for the written evaluations to be submitted as well for the record. There was CONSENSUS from the Commission to affirm all three Charter Officers. Regular City Commission September 23, 2019 Mayor Glasser requested the Commission consider a salary adjustment for the City Clerk and for this to be on the next agenda. She reported a salary comparison was conducted among Fernandina Beach, Neptune Beach, and Jacksonville Beach, along with a review of what the League of Mayors provides for salary information. City Clerk Bartle has been with the COAB for 28 years, providing a wealth of institutional knowledge and history with the city. Ms. Bartle is a Certified Municipal Clerk and is continuing to work towards her Masters Certification. If amenable to this, Mayor Glasser is requesting consideration for a 4 1/2 % increase. 6 CONSENT AGENDA 7 COMMITTEE REPORTS 8 ACTION ON RESOLUTIONS 8A. Resolution No. 19-55 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, APPROVING RENEWAL OF ALL LIABILITY INSURANCES AND WORKERS' COMPENSATION INSURANCE WITH PREFERRED GOVERNMENTAL INSURANCE TRUST FOR 2019-2020, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE MEMORANDUM OF UNDERSTANDING. Mayor Glasser read the Resolution by title. CM Gerrity introduced Shawn Wilson, Harden & Associates, insurance broker, and Mr. Wilson addressed the Commission. As detailed in the staff report which is part of the agenda, Mr. Wilson reviewed the RFP process which were sent to PGIT and FMIT, the City's two incumbent carriers, and the comparison of their responses. PGIT is able to provide a reduction in premiums as compared to last year's. A brief discussion ensued and all question were answered by Mr. Wilson and staff. MOTION: To accept Resolution No. 19-55. Regular City Commission September 23, 2019 8B. Resolution No. 19-48 A RESOLUTION OF THE CITY OF ATLANTIC BEACH AUTHORIZING THE EXECUTION OF A NORTH BEACHES PILOT PARKING MANAGEMENT PROGRAM INTERLOCAL AGREEMENT; AUTHORIZING THE MAYOR TO EXECUTE ANY CONTRACTS AND PURCHASE ORDERS AS NECESSARY TO EFFECTUATE THE PROVISIONS OF THIS RESOLUTION; AND PROVIDING AN EFFECTIVE DATE. Mayor Glasser read the Resolution by title. CA Durden addressed the Commission and stated she worked with Principal Planner Amanda Askew on the pilot parking program, the red line resolution review, and the Interlocal Agreement review. Neptune Beach is in agreement with one word change. MOTION: To approve Resolution No. 19-48 as read. Motion: Blythe Waters Second: Brittany Norris Discussion ensued about parking changes, reasons to move forward, and the flexibility of the program. The Commission extended their thanks to the City Attorney and staff for all their work on the Interlocal Agreement and the Resolution. Resolution No. 19-54 A RESOLUTION OF THE CITY OF ATLANTIC BEACH PROVIDING FOR PROGRAM DETAILS RELATED TO THE NORTH BEACHES PILOT PARKING MANAGEMENT PROGRAM; PROVIDING FOR AUTHORIZATION TO DELEGATE IMPLEMENTATION AND ENFORCEMENT OF THE PROGRAM TO THE JOINTLY DESIGNATED DISTRICT PARKING OPERATOR, RTA CONSULTING, INC.; AND PROVIDING FOR AN EFFECTIVE DATE. Mayor Glasser read the Resolution by title. CA Durden addressed the Commission explaining this Resolution will set forth the program details for the 18 month Pilot Program start/end dates, reports, rates, hours of operation, seasonal adjustments, special events, customer service, resident registration, payment process, parking zones, and established spaces. CA Durden extended her Regular City Commission September 23, 2019 thanks to Commissioner Norris for her input on Exhibit A. A brief discussion ensued about ADA designated parking and free parking. MOTION: To adopt Resolution No. 19-54, including the friendly amendment. Motion: Brittany Norris Second: Blythe Waters Discussion ensued about prohibited parking hours, overnight parking, and having an available FAQ sheet for public distribution as well as on the City website. CA Durden requested allowing for a friendly amendment in the motion and the second, to approve changes to the phone number and to allow people to come to COAB City Hall. Voice vote resulted in a 4 to 1 vote; motion carried for a friendly amendment. Discussion continued about overnight parking, and responsibilities of drivers. Resolution No. 19-56 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AUTHORIZING THE PURCHASE OF A 2019 FORD F-450 REGULAR CAB PICKUP TRUCK FROM ALAN JAY FLEET SALES FOR $81,031 TO REPLACE A 2008 FORD F-350 TRUCK WITH 88,636 MILES; AUTHORIZING THE CITY MANAGER TO EXECUTE CONTRACTS AND PURCHASE ORDERS IN ACCORDANCE WITH AND AS NECESSARY TO EFFECTUATE THE PROVISIONS OF THIS RESOLUTION; AND PROVIDING AN EFFECTIVE DATE. Mayor Glasser read the Resolution by title. CM Gerrity explained this is to replace an 11 year old utility truck as detailed in the staff report and is part of the agenda. MOTION: To approve Resolution No. 19-56 authorizing the purchase of a 2019 Ford F- 450 replacement pickup truck. Resolution No. 19-57 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AUTHORIZING THE EXECUTION OF AN EMPLOYMENT AGREEMENT DESIGNATING NICHOLAS SHANE CORBIN AS CITY MANAGER EFFECTIVE OCTOBER 6, 2019; AUTHORIZING THE MAYOR TO EXECUTE THE DOCUMENTS NECESSARY TO EFFECTUATE THE EMPLOYMENT AGREEMENT DESIGNATING SHANE CORBIN TO SERVE AS CITY MANAGER; AND PROVIDING AN EFFECTIVE DATE. Mayor Glasser read the Resolution by title. CM Gerrity stated this is the same contract as his own. There was a brief discussion about some contract details. Shane Corbin expressed his gratitude for working with Joe Gerrity and stated that he is satisfied with the contract and the negotiations. Mayor Glasser stated Mr. Corbin will commence duties as City Manager on October 6, 2019. MOTION: To adopt Resolution No. 19-57. Regular City Commission September 23, 2019 8F. Resolution No. 19-47 - Public Hearing Adoption of Resolution No. 19-47 for Millage Rate. A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA LEVYING THE AD VALOREM PROPERTY TAX MILLAGE RATE FOR MUNICIPAL PURPOSES ON ALL TAXABLE PROPERTY WITHIN THE CITY FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2019 AND ENDING SEPTEMBER 30, 2020; STATING THE PERCENTAGE BY WHICH THE MILLAGE TO BE LEVIED EXCEEDS THE ROLLED -BACK RATE; AND PROVIDING AN EFFECTIVE DATE. Mayor Glasser read the Resolution by title. CM Gerrity explained this is the second hearing of the budget process, levying the ad valorem property tax millage rate for all taxable property within the City. There are no changes since the first hearing. Mayor Glasser stated the following: The Tentative Millage Rate is 3.2285. The Roll -Back Rate is 3.0663. The Tentative Millage Rate is 5.29% higher than the Roll -Back Rate. The purpose for adopting the millage rate of 3.2285 is to maintain a level of ad valorem tax revenue sufficient to maintain adequate funding for the existing level of services at the estimated cost and to continue to maintain the City's infrastructure. Mayor Glasser opened the Public Hearing. There were no speakers, the Public Hearing was closed. MOTION: To adopt Resolution 19-47 setting the fmal millage rate for operating purposes of 3.2285. Regular City Commission September 23, 2019 9 ACTION ON ORDINANCES 9A. Ordinance No. 20-19-152 - Public Hearing and Final Reading Adoption of Ordinance No. 20-19-152, establishing the Operating Budget for Fiscal Year 2019/2020. AN ORDINANCE ADOPTING THE FINAL BUDGET FOR THE CITY OF ATLANTIC BEACH, FLORIDA FOR FISCAL YEAR BEGINNING OCTOBER 1, 2019 AND ENDING SEPTEMBER 30, 2020. Mayor Glasser read the Ordinance by title. CM Gerrity stated this is the final reading for the budget Ordinance for the next fiscal year. There are no changes since the first reading. Mayor Glasser opened the Public Hearing. There were no speakers, the Public Hearing was closed. MOTION: To approve Ordinance 20-19-152 establishing the operating budget for Fiscal Year beginning October 1, 2019 and ending September 30, 2020 in the amount of 40,468,074. Ordinance No. 90-19-244, Public Hearing AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, COUNTY OF DUVAL, STATE OF FLORIDA, REZONING THOSE LANDS DESCRIBED IN ATTACHED EXHIBIT A FROM RESIDENTIAL, SINGLE-FAMILY (RS -2) TO SPECIAL PLANNED AREA (SPA); PROVIDING FINDINGS OF FACT; REQUIRING RECORDATION; AND PROVIDING AN EFFECTIVE DATE. Please Note: Deferred by CDB; recommend that the Commission open the public hearing and continue it for November 12, 2019) Mayor Glasser read the Ordinance by title. Regular City Commission September 23, 2019 Shane Corbin explained this was deferred at the last meeting. He is requesting to do the same at this meeting, open and continue to November 12, 2019. Mayor Glasser opened the Public Hearing, there were no speakers, and continued to November 12, 2019. 9C. Ordinance No. 58-19-44, Introduction and First Reading AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, COUNTY OF DUVAL, STATE OF FLORIDA, AMENDING ARTICLE VI, DIVISION 5, DEFINED CONTRIBUTION PLANS; AND PROVIDING FOR CONFLICT, FOR SEVERABILITY AND FOR AN EFFECTIVE DATE. Mayor Glasser read the Ordinance by title. CM Gerrity spoke about the Florida Retirement System (FRS) and explained why the COAB is not able to do so due to the existing pension plans. The current plan is an opt - in for employees and it is requested to change to an opt -out plan - where every new employee is enrolled in the existing 401K program, and change vesting from five years to three years. Mr. Gerrity stated he feels there is an obligation to help employees plan their retirement and to keep COAB an attractive place to work. Congratulated Joe Gerrity on his retirement and asked him to keep in touch. Requested permission to have CA Durden look at her contract for clarification on some items. There was CONSENSUS from the Commission. Regular City Commission September 23, 2019 City Attorney Durden Thanked the Commission for their vote of confidence and their compliments. Congratulated Shane Corbin as the new City Manager, noting his creativity and knowledge, and stated he is fun to work with. Congratulated Joe Gerrity on his retirement, stating it has been a pleasure to work with him. Expressed her gratitude to have worked with Kevin Hogencamp, Shane Corbin, and Joe Gerrity - they have made her a better City Attorney. Ms. Durden stated she has a potted live oak tree that has grown from acorn from the historic Treaty Oak in Jacksonville. She is giving this tree to the COAB to plant in honor of City Manager Joe Gerrity. 12 CLOSING COMMENTS BY CITY COMMISSIONERS AND CITY MANAGER Commissioner Anderson Thanked CM Gerrity for easing her entry into the Commission and providing orientation about the City and all the departments. Commissioner Kelly Extended her thanks to CM Joe Gerrity. Commissioner Norris Inquired about the use of parking revenue in City. Mayor Glasser explained this can be put on an agenda for discussion. Extended her thanks to CM Gerrity. She has enjoyed working with him, especially as a new politician. Commissioner Waters Stated he has been an excellent City Manager, just what the City needed. He's efficient, drama free, and a reminder about balancing life and commitments and he's done it with grace. Mayor Glasser Stated she has learned from CM Joe Gerrity that things work out the way they are supposed to. He has been very creative with solutions, he's been an excellent partner and is leaving on a high note. Joe Gerrity is a man of integrity! Joe Gerrity Thanked the Commission who hired him. He is grateful for the opportunity to work in COAB and thanked this Commission. As the only male sitting amongst a Commission of women, a Police Department Chief, a City Attorney, and a City Clerk - it has been said 'there he is - sitting with his Angels!' He thanked all the staff members and stated they are the hardest working people. Mr. Gerrity wished Shane Corbin the best of luck. Mr. Gerrity stated Kevin Hogencamp has been a great Deputy City Manager and thanked him for his hard work!
