08-26-19 Regular City Commission MeetingMINUTES Regular City Commission Meeting Monday, August 26, 2019 - 6:30 PM Commission Chamber INVOCATION AND PLEDGE OF ALLEGIANCE Mr. Calvin Brown, Leroy Everett's best friend, retired Vietnam Veteran, and retired FWC Officer gave the invocation, followed by the Pledge of Allegiance. CALL TO ORDER: Mayor Glasser called the meeting to order at 6:30 PM. Mayor Glasser recognized the service members present and welcomed former Mayor Suzanne Shaughnessy, Jacksonville Councilman Rory Diamond, Leroy Everett's sister Dianne Kennedy, aunt Coretta Stewart, and other family members. City Clerk Bartle called the roll. Approve minutes of the Commission Workshop on July 22, 2019. 1B. Approve minutes of the regular Commission meeting on July 22, 2019. 1C. Approve minutes of the Town Hall meeting on August 3, 2019. Mayor Glasser asked if there were any corrections or changes needed. There were no corrections to the minutes. ACTION: Minutes stand as submitted. Comments from Councilman Rory Diamond Jacksonville Councilman Rory Diamond stated that he represents the beaches and downtown Jacksonville and listed his current/main projects as: Penman Road north / south thoroughfare Mayport Road -Jacksonville Section Completion of Jacksonville Beach Pier He briefly spoke about his work as CEO of Canines for Warriors, introduced his Council Executive Assistant McKenzie Conner, and welcomed anyone to call her with questions or concerns. PUBLIC COMMENT Mayor Glasser explained the process for public comments and opened Courtesy of the Floor to Visitors. City Clerk Bartle called each speaker to the podium. Lenny Jevic stated he is overwhelmed and humbled by the attendance and show of support for SFC Leroy Everett. He read a biography of SFC Everett's life. Calvin Brown spoke about growing up as best friends with SFC Leroy Everett. Theodore Martin spoke about SFC Leroy Everett as a friend and as a fellow paratrooper. Richard Johnson Jr. spoke about growing up with SFC Leroy Everett and thanked the City for the road markers in his honor. Charlie Williams III spoke of his thankfulness throughout the years for his friend SFC Leroy Everett. Velcie Hicks Lee spoke about childhood memories with her cousin, SFC Leroy Everett. Pete Dowling spoke about his fond memories of SFC Leroy Everett's mother and his love and respect for the family. John Gadson described SFC Leroy Everett as a great friend, neighbor, and a child of God. Wilber Smith spoke about the military service of his nephew, SFC Leroy Everett, along with that of his brothers. Edward Waters spoke about SFC Leroy Everett's commitment to serve. Mayor Glasser asked all members and graduates of Douglas Anderson High School here in support of SFC Leroy Everett to stand and be recognized. She also recognized and thanked Jax Vets and Vet Care. RESOLUTION NO. 19-39 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FL HONORARILY DESIGNATING A PORTION OF DUTTON ISLAND ROAD WEST INSIDE DUTTON ISLAND PRESERVE, FROM THE FRONT GATE WESTBOUND TO THE FRONT PARKING LOT INCLUDING THE BRIDGE IN THE CITY OF ATLANTIC BEACH, AS "U.S. ARMY SGT. LEROY EVERETT MEMORIAL PARKWAY"; DIRECTING CITY STAFF TO ERECT AND PROUDLY DISPLAY SUITABLE MARKERS TO HONOR ATLANTIC BEACH RESIDENT SGT. LEROY EVERETT, WHO GAVE HIS LIFE FOR OUR COUNTRY DURING THE VIETNAM WAR AND THUS DESIGNATING THIS PORTION OF ROADWAY AND BRIDGE; AND PROVIDING AN EFFECTIVE DATE. Mayor Glasser read the entire Resolution and provided the background of how discussions for honoring SFC Leroy Everett began and thanked Sergeant Lenny Jevic for his persistence. MOTION: Adopt Revised Resolution No. 19-39 as read. Motion: Candace Kelly Second: Brittany Norris Commissioner Kelly spoke about her military experience and thanked those that served in Vietnam. Commissioner Norris thanked Sergeant Jevic, Mayor Glasser, and the men and women who served. Commissioner Waters spoke about the importance of history, thanked the members of Douglas Anderson High School, the City, Sergeant Jevic, and the Commission for the marker that will continue to share the story of SFC Leroy Everett. Commissioner Anderson expressed her thanks to all the Veterans and all present in support of SFC Leroy Everett, an American Hero. Regular City Commission August 26, 2019 Mayor Glasser spoke of it being fitting for Atlantic Beach to recognize our military, specifically, SFC Leroy Everett who was the only Atlantic Beach resident to die in Vietnam. She thanked all for coming and spoke about the process of the marker placement and the on-site dedication ceremony coming this fall. City Manager's Report CM Gerrity asked the Commissioners to please review the Interlocal Parking Agreement in the upcoming draft agenda and contact the City with input or questions. 3B. Comments from Chief Michelle Cook Mayor Glasser explained this item will be on the next meeting agenda. 3C. Accept the 90 -Day Calendar (September through November 2019) Mayor Glasser reported that an Open House is scheduled for Thursday, August 29th for City Manager Candidate Shane Corbin and confirmed the Special -Called Meeting for Tuesday, September 3rd at 6:30 p.m. Commissioner Kelly reported that the Board and Committee Member Reception is on October 24th and encouraged the Commissioners to attend. She also reported that there will be an employee picnic on October 10th. ACTION: Consensus to accept the 90 -day calendar. Regular City Commission August 26, 2019 4 REPORTS AND/OR REQUESTS FROM CITY COMMISSIONERS Commissioner Anderson spoke about a citizen email she received concerning palm tree trimming in the parks and asked for input on whether it is an unnecessary expenditure. Mayor Glasser replied that they can discuss the question in Closing Comments. Commissioner Kelly reported that she has not been smelling as much barbeque smoke as before and reminded everyone about the Jazz Festival on September 7th and encouraged the Commissioners to attend. Mayor Glasser updated Commissioners regarding a notification received from the Naval base regarding upcoming water quality testing for private wells. She expressed interest in having the City Attorney look into whether there is a mechanism to lease city properties such as the vacant parcel located on the corner of Mayport Road and Renault Drive. 5 UNFINISHED BUSINESS FROM PREVIOUS MEETINGS None. 6 CONSENT AGENDA None. 7 COMMITTEE REPORTS None. 8 ACTION ON RESOLUTIONS 8B. RESOLUTION NO. 19-45 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AUTHORIZING THE POLICE DEPARTMENT TO PURCHASE ONE POLICE FLEET VEHICLES DURING THE 2018-2019 FISCAL YEAR. CM Gerrity explained the police department has funds in the budget to purchase an additional vehicle in order to make up for years when the minimum number of vehicles needed were not able to be purchased. Regular City Commission August 26, 2019 8C. RESOLUTION NO. 19-46 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, APPROVING THE AQUATIC DRIVE DRAINAGE IMPROVEMENTS FINAL DESIGN AND PERMITTING. CM Gerrity provided a brief background and reported the Jones Edmunds & Associates Inc. has completed the 30% design of the Aquatic Drive Drainage Improvements and reported the project is funded by the following: a $1.5 million dollar HMPG Grant 300,000 from the Governor's budget (State) 200,000 from the Stormwater reserves CM Gerrity asked the Commission to allow for authorization of Jones Edmunds to proceed with development of the plans to 100%, which would allow the project to go out to bid in January 2020. Mr. Brian Icerman thanked the Commission and reiterated the timeline for completion of the engineering work. Discussion ensued regarding challenges that could affect drainage of the neighborhood, the master plan, and the next phase. All questions were answered. Public Art Grant Request -1221 Mayport Road PCCD Corbin gave a brief background of the Mayport Road Public Art Program, reported this is the first completed application for mural grant funds, and provided a description of the grant programs funding and criteria. PCCD Corbin spoke about the artists' application, location and design of the mural, and artists not including any fees for their time. PCCD Corbin reported that the Cultural Arts and Recreation Advisory Committee reviewed the application and unanimously recommended approval of this project. He Regular City Commission August 26, 2019 added that if he could add to the recommendation, he would ask for funding for the artists' time. When asked how much, Mr. Corbin recommended $500.00 to each artist. Todd Rykaczewski, owner of World Revolt Art Gallery, one of the artists of the proposed mural, spoke about wanting to give back to the community. Other artists were recognized. MOTION: Approve funding for the art grant application request in the amount of $684.00 for 1221 Mayport Road. Motion: Brittany Norris Second: Cindy Anderson Mayor Glasser opened discussion. Commissioner Norris asked if anyone wished to make a motion to add payment to the artists. CM Gerrity expressed that the Commission Meeting is not a good place to negotiate an agreement. Commissioner Waters stated she is in support of having CM Gerrity negotiate with the artists for payment of their time, expressed her appreciation for the artists wanting to put a smile on faces, and thanked the artists for the work they have already done. Commissioner Anderson thanked the artists for their time and talent. Commissioner Kelly spoke in favor of adding money to their request. CM Gerrity reported he will happily negotiate with the artists on behalf of the Commission. Mayor Glasser stated she agreed with CM Gerrity not to negotiate payment during the meeting and stated the consensus is to negotiate reasonable payment to the artists. Regular City Commission August 26, 2019 10 ACTION ON ORDINANCES 10A. ORDINANCE NO. 90-19-243, Public Hearing and Final Reading AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, COUNTY OF DUVAL, STATE OF FLORIDA, REZONING THOSE LANDS DESCRIBED IN ATTACHED EXHIBIT A FROM RESIDENTIAL, GENERAL (RG) AND COMMERCIAL GENERAL (CG) TO TRADITIONAL MARKETPLACE (TM); PROVIDING FINDINGS OF FACT; REQUIRING RECORDATION; AND PROVIDING AN EFFECTIVE DATE. PCCD Corbin explained this is a request to rezone five parcels from a combination of Residential General (RG) and Commercial General (CG) to Traditional Marketplace TM). He spoke about the location, previous uses, and the concept for the requested rezoning which will include, but not be limited to, retail, restaurants, mobile food vending, live entertainment, taproom/brewery, and Airbnb. Mr. William Corley, applicant, expressed thanks and excitement for allowing their six properties to participate in the Mayport corridor's future concept plan and answered questions from the Commission. Regular City Commission August 26, 2019 12 CLOSING COMMENTS BY CITY COMMISSIONERS AND CITY MANAGER Commissioner Waters spoke about renaming the North Pier on Dutton Island for Mayor Lyman Fletcher. stated she is unclear to the grounds for the objection to tree trimming in Johansen Park and spoke in support of continued tree trimming in the parks. Commissioner Anderson clarified the objection to tree trimming was regarding allocation of funds in regard to palm trees, but not addressing water oaks with dead limbs that fall. Commissioner Norris spoke about the tree trimming concern and expressed interest in reviewing expansion of the contract to include a review of the larger trees and keeping an eye out for problem branches. stated she is in support of continued palm tree trimming in the parks. 12A. Florida League of Cities Update (Mayor Glasser) Mayor Glasser provided highlights from the Annual Florida League of Cities Conference on the following: Resolution for City Government Week in October Eligibility for Municipal Awards League's goal to have the Department of Justice provide guidance on ADA Website Compliance Short Term Rentals legislature Cyber Security Water Quality and Resiliency Funding Governor's speech Mayor Glasser addressed the tree trimming, expressed interest in knowing whether we budget for the dead trees/ Water Oaks and the Environmental Stewardship Committee's recommendation on trimming of palm trees. spoke regarding the house on Poinsettia Street. The City is doing everything that can be done and working with the bank on it. reported that PCCD Corbin and City Engineer Steve Swan will be giving a presentation at Beaches Watch September 4th on our Resiliency Study and Vulnerability Assessment and Adaptation Plan. discussed the process for the Special Called Meeting on Tuesday, September 3rd for interviewing city manager applicant Shane Corbin. as a result of Social Media being brought up at the League of Cities conference, stated she has unfriended all Commissioners and will no longer like any of their posts and that it is not personal. Regular City Commission August 26, 2019 CM Gerrity asked Commissioner Anderson for the location of the Water Oaks in Johansen Park and stated we have money in the contractual account to address the issue and will be happy to meet with Ms. Ghiotto.
