June 18, 2013 1 Community Development Board 1 The subject property is located within a Commercial General (CG) zoning district. Section 24-111(b) provides permitted uses-by-right within CG zoning districts: (8) On-premises consumption of beer and wine only in conjunction with a full service restaurant, which is a food service use where unpackaged ready-to-consume food is prepared onsite and served to the customer while seated at tables or counters located in a seating area within or immediately adjacent to the building. Section 24-111(c) provides permitted uses-by-exception within CG zoning districts: (3) On premises consumption of alcoholic beverages in accordance with Chapter 3 of this Code. June 18, 2013 2 Community Development Board Chapter 24 - Zoning 2 Section 3-5 provides for on-premises consumption with certain zoning districts: The sale of alcoholic beverages for on-premises consumption, including beer, wine, and liquor shall be properly licensed by the City of Atlantic Beach, and shall be limited only to restaurants, cafés, bars and private clubs within commercial general and commercial limited zoning districts or the central business district in compliance with Chapter 24 of the city code and subject to approval of a use-by-exception in accordance with section 24-63. Section 3-2 provides for hours of operation: Limited to 7:00am – 2:00am, all days of the week. Section 3-7 provides for required lighting: Sufficient lighting for the safety of patrons and employees during all times that the business is open and occupied by employees. Section 3-8 provides for on-premises consumption on licensee’s premises: Consumption allowed either inside of the building that is the licensed premises, or within an outdoor seating or dining area contiguous to the building that is owned or leased, and maintained and controlled by the licensee, per Section 3-8. June 18, 2013 3 Community Development Board Chapter 3 – Alcoholic Beverages 3 4-COP = “Beer, Wine and Liquor Consumption on Premises” SRX = “Special Restaurant” license, which can be obtained at any time, if certain requirements are met, and is an exception to the regular quota license, the number of which is restricted by county. Those requirements, monitored by DBPR-ABT, include: Established in connection with a full service restaurant, deriving 51% of gross revenue from sale of food and non-alcoholic beverages; and, Located in a facility having a minimum of 2,500 square feet of floor space under permanent cover; and, Provided there are a minimum of 150 permanent seats for patrons.
