Fifth Street Planning and Zoning Resource Corporation Oklahoma City, Oklahoma 73104 Re: 299 Atlantic Blvd. (RE # 172531 0000) – Zoning and Land Use Designation Dear Ms. Ellis: The subject development is recognized by the City of Atlantic Beach as a legally established use for this specific property.  The property is not within a Planned Unit Development, but is within the Central Business District (CBD) Zoning District and is designated as Central Business District on the City's Future Land Use Map of the Comprehensive Plan. Copies of these regulations are enclosed. This property is located within an area of the City subject to special design standards as set forth within enclosed Section 24-171 of the City’s Land Development Regulations. The property to the south is within the City of Neptune Beach; as such, I cannot address neighboring properties on the south side of Atlantic Boulevard. Other immediately adjacent properties are also within the Central Business District zoning category with the exception of the ocean-front Sea Turtle Inn property, which is zoned Commercial General (CG.) Certain parking waivers have been granted to uses within this shopping center in years past; however, these have not been continuously enforced. Existing parking does not meet the number of required spaces per current parking regulations. It has, and continues to be the City’s policy, to require that new development provide required parking, but in the case where an existing uses is later occupied by a similar use with no substantial increase in parking demand, no additional spaces are required. There are no nonconforming uses on this property; however, there are some nonconforming structure with respect to required building setbacks. The City acknowledges these as legal nonconforming structures. Any new construction would be subject to currently applicable setbacks. The City does not issue Certificates of Occupancy for interior build-out or renovation of individual units within shopping centers; however, building and fire inspections are performed as part of the Occupational Licensing and Building permit process for each unit. Files contain numerous Building and Sign Permits for individual units since the early 1970s. Older files related to this property have been microfilmed, and I have enclosed copies of these documents. Unfortunately, there is not a record of the original CO in City files. The City may not have required a Certificates of Occupancy at the time this building was in 1973, but again, the City considers the property to be a legal conforming use. The property, to the City’s knowledge, is currently in compliance with applicable local Land Development Regulations and Florida Building Codes.
