Just to summarize a few matters from our conversation this moring: 1) I am absolutely in favor of an in person sit down with Mr. Stelzmann. I am available on January 16, 2020 for this meeting. 2) While I understand the magistrate will do what he believes needs to be done, he should fully expect that I will be filing for a fine reduction based upon the difficulties experienced in obtaining a plan for shoring the property in a timely manner. 3) I did not receive notice, and I understand that it was sent to Wells Fargo's address, but the magistrate is aware that I represent Wells Fargo and there is no procedure for a Notice of Appearance. I have received service at my email address of every other order in this case, I do not see why I could not receive service of this notice of hearing. 4) I will be forwarding several emails that detail the efforts made by Wells Fargo to immediately comply with the Magistrate's order and the difficulties faced by Wells in reaching compliance. This will show that circumstances beyond our control have forced us into a corner where we face possible fines and liens associated with this case. If the Magistrate could please pay heed to these messages and hold off on the fines, it would be appreciated. Otherwise, we are prepared to defend ourselves via lien reduction as stated above. I discussed the bid with our attorney as it's quite high ($134,000.00). He asked that I talk it over with our engineer. I just got off the phone with him and he said the bid is extremely high. The amount of the property that needs shored is minimal considering the entire square footage and he advised it shouldn't cost more than $10,000 to do the work with the costs of repair work in the area. I explained our process of national vendor, sub -contractor, etc. and he still said it's extremely high. I also discovered that in order to properly complete a shoring we'll need the engineer to provide us with a drawing of what needs done prior to obtaining a permit. Perhaps that's why it's so high. Maybe they think the entire property needs shored, however, he advised even if we did the entire structure it wouldn't be more than $50k. I've asked him to provide the drawings so we can send it to Brookstone for review. I hope to have it by the end of next week. With all of this said, how should we handle the submitted bid? What kind of repercussion is this going to cause with the city/court?
