City Clerk Bartle called the roll. Approve Minutes of the September 9, 2019 Regular Commission Meeting. Mayor Glasser asked if there were any corrections or changes needed. There were no corrections to the minutes. Mayor Glasser stated the minutes stand as submitted. 2 COURTESY OF FLOOR TO VISITORS 2A. Proclamation recognizing North Florida Council Boy Scout Troops 15, 37 and 40 Mayor Glasser) Following introductions of the members of Boy Scout Troops 15, 37, and 40, Mayor Glasser read the Resolution which recognizes their efforts for responding to aid in emergency relief to the citizens of the Bahamas who suffered Hurricane Dorian. It was the most powerful natural disaster to make landfall in the Bahamas on September 1, 2019. The Boy Scouts coordinated with the three beach cities and conducted a relief drive on September 27 and 28, 2019, loading a 20 -foot truck with supplies to be shipped to the Bahamas. Regular City Commission October 28, 2019 2B. Presentations to Non -Profit Agencies Serving Seniors (Mayor Glasser) Mayor Glasser spoke about creating a line item in the City's budget to recognize and assist the organizations who provide many services to our senior citizens. These agencies are not eligible for the CARAC grants. Mayor Glasser introduced the representatives as follows: Leslie Lyne, Neptune Beach Senior Center Kathryn Latham, Beaches Council on Aging Lori Richards, Dial -a -Ride and BEAM Each representative provided a synopsis of the services they provide to the beach communities, as follows: Provide services to Atlantic Beach, Neptune Beach, Jacksonville Beach, Ponte Vedra Beach, and the West Beaches - over 1450 individuals received services. Transportation. Financial assistance - rent/mortgage, home repairs, utilities, food pantry, counseling. On behalf of the City of Atlantic Beach and their citizens, Mayor Glasser presented each organization with a check for $2,000.00. PUBLIC COMMENT Mayor Glasser explained the process for public comments and opened the Courtesy of the Floor to Visitors. City Clerk Bartle called each speaker to the podium. Michael Fogg submitted copies of photos and documents pertaining to replacement of cracked/broken gutter, curb, and sidewalk in the City right-of-way in front of his home, 366 Plaza. The work was permitted and completed in July 2019 and at his expense for $2075.00. Mr. Fogg explained that before the work was done he met with the Public Works Director, Scott Williams, to inquire about City plans/schedules and funding for this work. Mr. Williams advised that there were no plans for the sidewalks in the 300 block of Plaza for at least five (5) years. Mr. Williams advised Mr. Fogg that if he did the repairs at his own expense he could submit receipts to the City Manager and request reimbursement, if funds were available. Mr. Fogg then proceeded to permit and contract the work rather than wait on the City. As detailed in Mr. Fogg's documents, a couple months later the entire 300 block of Plaza was receiving parcels of sidewalk and curb demo/replacement. Forty nine (49) repairs were appropriated by former CM Gerrity and he is requesting reimbursement for his expenses. Jackson King spoke about spoke about book sharing and the Little Free Libraries, which are a part of his Eagle Scout project - Giving back to the community and promoting reading in our parks. Mr. King provided a handout showing a photograph of the completed structure. Aline King spoke about book sharing and the Little Free Libraries. Regular City Commission October 28, 2019 3 CITY MANAGER REPORTS 3A. City Manager's Report CM Corbin reported on the following: Tree planting in Royal Palms neighborhood - on Royal Palms Drive, Sailfish, and Plaza, approximately 150 trees. Parking concept on Sturdivant, behind the Gate Station and plans to meet with the residents/neighbors for feedback. Parks and Trails Masterplan charrette scheduled over the next two days. Mayport Mural Project grant scheduled on November 3, 2019, 2:00 - 5:30 PM. Paid parking update. DCM Hogencamp provided information about the Veteran's Day program, the website requesting information and photos to display of our Atlantic Beach veterans. 3B. Accept the 90 -Day Calendar (October through December 2019) There was a brief discussion about topics for the November 18, 2019 workshop. The City will dispense with the December 16, 2019 workshop due to upcoming holiday schedules and travel plans. ACTION: CONSENSUS to accept the 90 -Day Calendar. 4 REPORTS AND/OR REQUESTS FROM CITY COMMISSIONERS 4A. Update on Seminole Road Project (Mayor Glasser) Mayor Glasser spoke about the stormwater project on Seminole Rd., involving a sidewalk replacement, and requested the City Manager to explain the project. CM Corbin provided a slide presentation and spoke about the replacement of a sewer pipe under the sidewalk. There have been discussions about widening the sidewalk to eight feet, when replaced, so that it can be a multi -use path. The projected costs fall within the estimated budget. Following a brief discussion there was CONSENSUS from the Commission to move forward with the widening plans. 4B. Whistleblower Guidelines (Commissioner Anderson) Commissioner Anderson spoke about the laws pertaining to Whistleblower Guidelines. Ms. Anderson explained why it is important to have a specific policy for City staff. She inquired if there was agreement to have the HR Director move forward on this task - to confirm if there is current policy on the topic or to establish policy for Whistleblower Guidelines. There was CONSENSUS from the Commission to move forward. Regular City Commission October 28, 2019 Commissioner Anderson Spoke about the Little Free Libraries and suggested having varying access heights. Commissioner Norris Spoke about a city-wide composting site. Commissioner Kelly Spoke about the successful Board Member Reception and thanked everyone for participating. Spoke about the upcoming employee training for retirement planning. Spoke about replenishing and stocking the Little Free Libraries. Inquired about receiving an update on LEEDs and the City goals. Spoke about Mission House and their need for towels. Spoke about E Scooters and regulations. 5 UNFINISHED BUSINESS FROM PREVIOUS MEETINGS None. 6 CONSENT AGENDA None. 7 COMMITTEE REPORTS None. 8 ACTION ON RESOLUTIONS 8A. Resolution No. 19-60 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AUTHORIZING THE POLICE DEPARTMENT TO PURCHASE FOUR POLICE FLEET VEHICLES DURING THE 2019-2020 FISCAL YEAR. Mayor Glasser read the Resolution by title. Sgt. Chase Jamison, COAB Police Department, addressed the Commission and reviewed the staff report as detailed in the agenda for the purchase of four vehicles. Mayor Glasser read the Resolution by title. Sgt. Jamison addressed the Commission and reviewed the staff report as detailed in the agenda for the purchase of nine portable radios and five mobile radios. These have been budgeted for in the FY2019/2020 budget. MOTION: To adopt Resolution No. 19-61. HR Director Cathy Varian addressed the Commission and reviewed the staff report as detailed in the agenda for the employee health care insurance benefits for 2020. Resolution No. 19-63 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AUTHORIZING THE POLICE DEPARTMENT TO PURCHASE EQUIPMENT TO OUTFIT FOUR POLICE FLEET VEHICLES DURING THE 2019-2020 FISCAL YEAR. Jamison addressed the Commission and reviewed the staff report as detailed in the agenda for the purchase of required operating equipment for each of the four new police vehicles. Resolution No. 19-64 A RESOLUTION OF THE CITY OF ATLANTIC BEACH ESTABLISHING GUIDELINES FOR LITTLE FREE LIBRARIES IN CITY PARKS; AND PROVIDING AN EFFECTIVE DATE. Mayor Glasser read the Resolution by title. DCM Hogencamp addressed the Commission and reviewed the staff report as detailed in the agenda for establishing guidelines and regulations for Little Free Libraries in City parks. Discussion ensued about including a limit per park, resulting in a suggestion to amend the Resolution. Also there was discussion about providing a location map and responsibilities for a maintenance plan. MOTION: To adopt Resolution No. 19-64 with an amendment to include language 'not to exceed two per park' after the list of parks (Donner, Jordan, Russell and Bull in the first bullet item). There was a brief discussion about the pending projects with the Girl Scouts and Boy Scouts and DCM Hogencamp provided an update. Skip Schroeder, Scoutmaster for Troop 215, addressed the Commission and explained their requirements of Eagle Scout projects and maintenance/safety of the same. He also stated the scouts could help with stocking the Little Libraries with books. 9 ACTION ON ORDINANCES 9A. Ordinance No. 20-19-153, Introduction and First Reading AN ORDINANCE AMENDING THE OPERATING BUDGET FOR THE CITY OF ATLANTIC BEACH, FLORIDA FOR FISCAL YEAR BEGINNING OCTOBER 1, 2019 AND ENDING SEPTEMBER 30, 2020, AND PROVIDING AN EFFECTIVE DATE. Mayor Glasser read the Ordinance by title. CM Corbin addressed the Commission and reviewed the Staff Report which is part of the agenda. He explained the purpose is to appropriate funding for tree plantings for FY2019/2020. MOTION: To Approve Ordinance No. 20-19-153. Regular City Commission October 28, 2019 9B. Ordinance No. 90-19-244 Public Hearing and First Reading AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, COUNTY OF DUVAL, STATE OF FLORIDA, REZONING THOSE LANDS DESCRIBED IN ATTACHED EXHIBIT A FROM RESIDENTIAL, SINGLE-FAMILY (RS -2) TO SPECIAL PLANNED AREA (SPA); PROVIDING FINDINGS OF FACT; REQUIRING RECORDATION; AND PROVIDING AN EFFECTIVE DATE. Mayor Glasser read the Ordinance by title. PCD Director Askew addressed the Commission and provided a slide display showing six lots currently zoned Residential, Single -Family (RS -2) and the request to amend to a Special Planned Area (SPA). She reviewed the Staff Report which explains the proposed development and is part of the agenda. The Developer, Alex Sifakis, addressed the Commission and spoke briefly about his proposed project. Mayor Glasser opened the Public Hearing that was continued from September 9, 2019. There were no speakers and Mayor Glasser closed the Public Hearing. A lengthy discussion ensued about the market rate of the proposed homes, the reduction of density, enhancement to impervious surface, environmental assessment, conservation purposes, and the purpose/intent/development of a SPA district. MOTION: To approve Ordinance No. 90-19-244 with the understanding there will be an addition to Exhibit C to reflect that none of the lots shall be subdivided, and that it is consistent with the intent of the Comprehensive Plan. Regular City Commission October 28, 2019 11 CITY ATTORNEY/CITY CLERK REPORTS AND/OR REQUESTS City Clerk Bartle stated that the next meeting will be on a Tuesday, November 12, 2019 due to a holiday on Monday. Also there are two elections that conflict with meetings so two Commission workshops will be cancelled - March 16 and August 17, 2020. 12 CLOSING COMMENTS BY CITY COMMISSIONERS AND CITY MANAGER Commissioner Norris Spoke about the request for reimbursement made by Michael Fogg and was not in favor of setting this precedent. Commissioner Anderson Spoke about Mr. Fogg's request and suggested using the amount that it cost the City for the same space, which was approximately $500.00. Mayor Glasser Spoke about the Special Magistrate Hearing for 196 and 198 Poinsettia St. Spoke about dune and beach access protection taken due to Hurricane Dorian in September. The Emergency Order issued by Governor DeSantis did not cover those expenses. A fine resulted and the City has been advised that we can propose and complete a project along the coast line commensurate with the fine. Spoke about considering a Resolution relating to preemption of recyclable and polystyrene materials and provided copies of correspondence from a citizen of Tequesta, FL and a copy of a Resolution of the Town of Palm Beach, FL. Also Ms. Glasser spoke about the interpretation of the Human Rights Ordinance and the Florida Civil Rights Act and provided copies of correspondence from the City of Miami Beach. Mayor Glasser will forward this to City Attorney Durden for direction on whether or not to take action. Has meeting with School Board and local Principals regarding traffic, sidewalks on Mayport Rd., and safety. Regarding Michael Fogg's Request: Mayor Glasser was reluctant to reimburse. Commissioner Norris doesn't want to set this precedent. Commissioner Anderson supports the City Manager's decision. Commissioner Kelly supports a one-time waiver for reimbursement based on what it cost the City. Commissioner Waters doesn't want to set this precedent.
