01-27-20 Regular Comission Meetling Adopted MinutesMINUTES Regular City Commission Meeting Monday, January 27, 2020 - 6:30 PM Commission Chamber INVOCATION AND PLEDGE OF ALLEGIANCE CALL TO ORDER: Mayor Glasser called the meeting to order at 6:30 PM. City Clerk Bartle called the roll. ROLL CALL: Present: Ellen Glasser, Mayor - Seat 1 Cindy Anderson, Commissioner - Seat 2 Blythe Waters, Mayor Pro Tem / Commissioner - Seat 3 Candace Kelly, Commissioner - Seat 4 Brittany Norris, Commissioner - Seat 5 Also Present: Brenna Durden, City Attorney (CA) Shane Corbin, City Manager (CM) Donna Bartle, City Clerk (CC) Kevin Hogencamp, Deputy City Manager (DCM) Lori Diaz, Deputy City Clerk 1 APPROVAL OF MINUTES 1A. Approve minutes of the Regular Commission Meeting on October 14, 2019. Mayor Glasser asked if there were any corrections or changes needed. There were no corrections to the minutes. Mayor Glasser stated the minutes stand as submitted. 2 COURTESY OF FLOOR TO VISITORS 2A. Proclamation for National Gun Violence Survivors Week Mayor Glasser spoke about the Proclamation recognizing survivors of gun violence. She invited Katie Hamil and the group from Moms Demand Action for Gun Sense in America up to the podium for reading of the Proclamation. Katie Hamil spoke about gun violence statistics and thanked Mayor Glasser and the City of Atlantic Beach. Mayor Glasser read the Proclamation into the record and presented it to the group. Regular City Commission January 27, 2020 PUBLIC COMMENT Mayor Glasser explained the process for public comments and opened the Courtesy of the Floor to Visitors. City Clerk Bartle stated there were no speaker cards submitted. No one wished to speak so Courtesy of the Floor was closed. 3 CITY MANAGER REPORTS 3A. City Manager's Report CM Corbin addressed the Commission and reported on the following: Spoke about the tour of 870 Seminole Road, no immediate issues were recognized. Next step is a traffic study to determine what impact a turn lane would have to the 5 -way intersection and congestion relief. Reported that the Building Department has sent a letter to 812 Ocean Boulevard regarding expired permits. Reported there was one response to our Invitation to Negotiate (ITN) with JEA- Moyle Law Firm. Due to significant changes since the ITN the City is working on revision of scope. Stated in future agendas the Building and Financial Reports will be listed under Consent Agenda. 3B. Accept the 90 -Day Calendar (February 2020 through April 2020) There was CONSENSUS to accept the 90 -day calendar. 3C. Quarterly Financial Report for October through December 2019 Finance Director (FD) Melissa Burns presented the City's Quarterly Financial Report for fiscal year 2020, which is included in the agenda packet. She presented a PowerPoint of the information and reported on the following: Budget, Revenues, Expenditures. Resource Allocation -Reported Debt Service. General Fund. Increase in Cash Balances as of Dec. 31. Cash and Investments as of Dec. 31. Special and Enterprise Funds -Parking Fund located here. Questions and discussion ensued regarding what to look for in the reports. Mayor Glasser reported the COAB received correspondence from the President of the Florida Government Finance Officers Association commending FD Burns and acknowledging her dedication to financial integrity. 3D. Building Department Monthly Activity Report for December 2019 Building Official Dan Arlington gave an overview of the Building Department's Monthly Activity Report as of December 2019, which is included in the agenda packet. Regular City Commission January 27, 2020 Mr. Arlington reported on the following: Permits issued. Permit Fees. Construction Value. Inspections performed. Mr. Arlington reported that he hopes to work on providing more information on the Building Departments web page, and preparing for the Community Rating System CRS), coming up this summer. He explained the CRS is a voluntary incentive program of The National Flood Insurance Program (NFIP) that recognizes and encourages community floodplain management activities. As a result, flood insurance premium rates are discounted for residents and businesses in flood zones. The City of Atlantic Beach (COAB) currently rates a 7 and receives a 15% discount, but the goal is 20%. Questions and discussion ensued regarding what to look for in the reports. He also spoke about builders hiring their own inspectors, their auditing process, and the legislation that allows this. Mayor Glasser thanked Mr. Arlington. CM Corbin inquired how often the Commission would like to see these reports on the agenda. There was Consensus to see the Finance report monthly and the Building Department report quarterly. 4 REPORTS AND/OR REQUESTS FROM CITY COMMISSIONERS 4A. Use of Parcel: Renault Drive & Mayport Road (Mayor Glasser) Mayor Glasser requested feedback on the best way to reach out to the community for proposals to use this parcel. Discussion ensued regarding safety, uses, and the desire for the community to bring forth their proposals for leasing of the parcel. CM Corbin stated he will reach out to individuals in the community. Commissioner Kelly spoke about E -scooters and the possibility of them setting up operations in our community. Commissioner Norris requested the following regarding the "No Parking" signs currently on Main Street: Staff to figure out the origin of the signs. Staff to provide a recommendation whether they are necessary or not. Chief of Police to provide any safety implications if the signs are removed. A staff report on what our current policy is of how these signs get placed. Regular City Commission January 27, 2020 She stated she believed there has been incidences where someone can just call and complain and a sign gets put out, as opposed to a study or recommendation given by staff or police, etc. 5 UNFINISHED BUSINESS FROM PREVIOUS MEETINGS None. 6 CONSENT AGENDA None. 7 COMMITTEE REPORTS None. 8 ACTION ON RESOLUTIONS 8A. RESOLUTION NO. 20-07 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AWARDING BID #1920-03 FOR THE 12TH STREET DUNE WALKOVER. Mayor Glasser read the Resolution by title. Public Works Director Scott Williams addressed the Commission and gave background on the project. He stated the lowest bid was $94,000.00 and under the budget. Discussion and questions ensued about the contractor, Haywood Construction Group, LLC, and this project being a result of a Department of Environmental Protection DEP) Consent Order. CM Corbin reported that the DEP found COAB (along with Neptune and Jacksonville Beaches) out of compliance with a rule about moving sand without prior authorization - during Hurricane Dorian. This project satisfies that issue. MOTION: To approve Resolution 20-07 as read. RESOLUTION NO. 20-08 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AWARDING BID #1920-01 FOR THE SEMINOLE ROAD DRAINAGE IMPROVEMENTS. Regular City Commission January 27, 2020 Mayor Glasser read the Resolution by title. Public Works Director Scott Williams addressed the Commission and gave background on the project. He stated the lowest bid was $463,000.00. Questions and discussion ensued about materials, construction and contractors. Mr. Williams stated this improvement will not eliminate flooding altogether, but that it will improve drainage as a lot of the pipe currently down there is crushed. RESOLUTION NO. 20-09 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA APPROVING THE PURCHASE OF A BUILDING INSPECTOR'S VEHICLE, FOR THE AMOUNT OF $ 26,145.00 AND PROVIDING AN EFFECTIVE DATE. Mayor Glasser read the Resolution by title. CM Corbin reported that the request for a hybrid came from the Building Departments desire to assist in raising our City's LEED score. Building Official Dan Arlington addressed the Commission and spoke about the need and budget for the vehicle. Questions and discussion ensued about maneuverability of the RAV4, the savings, and that the hybrid would pay for itself in 3 years. Mayor Glasser stated she has no concerns with the hybrid. ORDINANCE NO. 65-20-40, Public Hearing and Final Reading AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, FLORIDA, AMENDING CHAPTER 19 OF THE CODE OF ORDINANCES, STREETS, SIDEWALK AND OTHER PUBLIC PLACES, BY AMENDING SECTION 19-1, CONSTRUCTION WITHIN AND/OR USE OF RIGHT-OF-WAY, TO PROHIBIT PERMANENT BASKETBALL GOALS; AND PROVIDING AN EFFECTIVE DATE. Mayor Glasser read the Ordinance by title. CM Corbin reported at the last Commission meeting this Ordinance was on the agenda and the Public Hearing was opened and continued; no action was taken. He provided the background which is detailed in the staff report included in the agenda packet. Mayor Glasser opened the Public Hearing that is continued from January 13, 2020. There were no speakers. The Public Hearing was closed. There were no questions for staff. MOTION: To adopt Ordinance No. 65-20-40 as read by title. Regular City Commission January 27, 2020 11 CITY ATTORNEY/CITY CLERK REPORTS AND/OR REQUESTS CA Durden Stated that Ethics Training for elected officials is a 4 hour mandatory requirement every calendar year and that the Florida League of Cities has numerous services. If Commissioners are interested or have questions she is glad to assist. City Clerk Bartle Reported on her attendance to the IIMC Regional conference in Orlando last week. 12 CLOSING COMMENTS BY CITY COMMISSIONERS AND CITY MANAGER Commissioner Norris inquired whether the City of Jacksonville would provide a group Ethics Training. Mayor Glasser replied she was informed they are happy to provide Ethics Training at no cost. Mayor Glasser spoke about the following: Spoke about the gun violence proclamation, spoke about her history in law enforcement, expressed thanks for the opportunity to bring in the Moms Demand Action for Gun Sense in America. The Donna Run will be on February 8th and 9th. School Board member Elizabeth Anderson will be here on February 11 th for an Education Forum. Leroy Everett Day will be February 15th. Speaking before the North Florida Transportation Planning Organization (TPO) Board on February 13th regarding our Complete Streets proposal. Requested the Commission to consider adding "not having a residency requirement for the City Manager" on the next election referendum.
