While NEFAR supports incentive -based financing programs that enable homeowners to improve the energy efficiency of homes and take advantage of reduced energy costs we have some very strong concerns about the adverse effects of the PACE program on homeowners, the real estate market and mortgage availability. Although the program may appear beneficial, consumer protections are minimal at best and the program is subject to very little oversight; mostly self - policing. There are many pitfalls that can result in harm to homeowners and the real estate market in general with this program. Therefore, we cannot support the PACE program for residential use at this time. Consumer Protection Participating companies can approve a consumer if they are current on their mortgage and property taxes. There is no requirement to consider the entire credit history and current debt load. This runs the risk of adding debt to consumers who cannot afford it and are at high risk of default. Several of the companies engaging in the program have been criticized for potential predatory lending activity directed at senior citizens and low-income homeowners. There is also concern over the lack of proper disclosure with PACE loans. PACE is not subject to the Truth in Lending Act and there is very little oversight of the program. In addition, PACE providers utilize contractors to sell the program. Thus, individuals representing roofing companies, HVAC or window installers act as loan brokers; selling the program to consumers. Negative Impact on Home Sales A homeowner trying to sell a home with a PACE assessment attached must have the PACE Loan assessment paid off at closing if the buyer is using FHA insured financing. In December 2017 HUD published a mortgagee letter stating Properties encumbered with PACE obligations will no longer be eligible for FHA -insured forward mortgages." As of June 2018, VA loans are no longer allowed for properties with a PACE assessment. In addition, the Federal Housing Finance Agency (FHFA) prohibits the Government Sponsored Enterprises (GSEs), Fannie Mae and Freddie Mac from purchasing a mortgage that has a PACE assessment on the property. Furthermore, lenders who typically don't repackage their mortgages up to Fannie Mae and Freddie Mac don't allow them either because they want the flexibility to sell off those mortgages if necessary. Credit and Mortgage Availability Like property taxes, PACE liens take priority over mortgages. This makes the bonds easier for municipalities to sell, but if a home is foreclosed on, liens are paid before the mortgage lender can recoup any money. The presence or potential presence of a PACE loan, taking the first position ahead of the mortgage, invariably leads to the devaluation of the mortgage as a secured asset. This has the effect of either making mortgages more risky and costly, or leading to situations where mortgage credit is tighter or unavailable. Furthermore, it is unclear at best whether the resulting improvements add enough value to compensate for the additional risks. 7801 Deercreek Club Rd., Jacksonville, FL 32256 904) 394-9494 • www.NEFAR.com 111 NORTHEAST FLORIDA ASSOCIATION OF REALTORS Conclusion As stated above, the FHFA does not allow Fannie Mae, Freddie Mac, and Federal Home Loan Banks to purchase mortgages encumbered by PACE liens. Today, approximately 75% of residential properties utilize Fannie Mae, Freddie Mac, or Federal Home Loan Banks to finance residential mortgages either directly or indirectly. In a community that has a high number of senior citizens, first time home buyers, veterans, and those in search of workforce housing, it does not, in our eyes, seem prudent to engage in a program that could deny 75% of the financing market to a property. We appreciate the opportunity to comment on the PACE loan program and support providing property owners with the education, incentives, and resources to strengthen their homes and save energy. We also appreciate the emphasis on the voluntary nature of these programs, but believe that, at this time, consumer protections and the safety and soundness of real estate mortgage markets must take precedence over other ancillary, albeit important, concerns and ask for careful consideration of these adverse effects when reviewing the PACE program for residential use at this juncture. PACE or Property Assessed Clean Energy Program is a type of loan used in Florida to finance energy efficiency improvements, renewable energy improvements and wind resistance improvements. Is PACE free or low-cost? No. PACE home improvements are not free or cheaper than normal prices. When you sign the PACE loan documents, you are agreeing to repay the full cost of the work. How do I qualify for the loan? Unlike conventional lenders, PACE Lenders are not required to check whether you can afford to repay the loan, so please make sure you can afford the annual payment. How do I repay the loan? The loan repayment will be added to your property tax assessment so you tax bill will increase. The entire tax assessment must be paid in full or you will be in default on your property taxes and a lien will be placed on your home. If you have a mortgage, your lender probably includes the property taxes in your monthly payment. If so, your monthly mortgage payment will increase and if you do not pay it your home could be foreclosed. Do I pay interest for the loan? Yes. Pace lenders charge between 6% and 9% per year, over 20 years, which may be higher than other loan financing. There may be low interest loans available, like utility sponsored programs or federal weatherization programs. Lance Henderson is one of the many victims alleging shady and intimidating practices by Bruno, stating that the company deceived him and even threatened to take over his home. Henderson said the company also pulled his credit without approval, causing his score to dip. He decided not to pay and said the company threatened to sue him and foreclose his home. According to Henderson, Bruno Total Home never completed the work and wanted the company to be held responsible. Bruno Total Home services businesses across the state and serves 22,000 homes a year. Couple says they were duped by Bruno Total Home They have sued the embattled air conditioning company Posted: 10:20 PM, Jan 16, 2019 Updated: 7:33 AM, Jan 17, 2019 CAPE CORAL, Fla. -- A Cape Coral couple is telling their story of a bad experience with Bruno Total Horne. They even slapped the embattled company with a lawsuit before state officials raided Bruno's Bonita Springs offices this week. Dennis Haussler says he bought a new air conditioner from Bruno Total Home Performance after hearing a radio advertisement. "I'm driving to work in the morning and I hear this Louis Bruno on the radio all the time, and he's saying, don't take money out of your pocket," said Haussler, who lives in Cape Coral. The program Bruno was selling is called Property Assessed Clean Energy, or PACE. It allows customers to make energy efficient investments in their home and finance it through voluntary assessments of their property tax bill. Haussler was surprised at how quickly he was approved; "Not even signed a paper." But the real surprise came in the mail, when the Hausslers got a bill for 37,000, with first payment due in 3o days, even though they were told by Bruno they had three years to make their first payment. They called Louis Bruno, Haussler claimed Bruno told him he'd call Greensky, the finance company himself. "He kept telling us he was telling us he was talking to some guy in California from Greensky, we ended up talking to Greensky and they said they were located in Atlanta," said Haussler. Dennis says the finance company told him they had never heard of the PACE program, that's when the couple knew they had been had. Haussler called Mike Chionopoulos who filed a fraud lawsuit against the company and other lawsuits may follow. "This the first time that I've had any categorical or widespread complaints regarding an air conditioning or heating company," said Chionopoulus. The Haussiers watched in shock as FDLE agents raided Bruno's office Tuesday, an incident that Chionopoulos says may help prove his case against the company. Consumer Warns About Pitfalls in Financing Program for Home Improvement Projects What you should know before using PACE program to finance home improvement projects By Sasha Jones Published Nov 13, 2018 at 6:30 NA i 11pdated at 6:59 PM EST on Nov 13, 2018 Jorge Andrade and Thomas Bavota are two consumers out of more than 21,000 in South Florida who have financed a home improvement project using what's known as PACE, the Property Assessed Clean Energy Program. Both had different results. In our area, consumers have financed more than $140 million in projects using the financing program. The commercials for the PACE program advertise no upfront cost or financial verification needed. The money can be used to finance energy efficiency projects like air conditioning, solar panel and impact window installation. Jorge Andrade says the financing made his roof project possible. Since they said they had financing for roofing, we thought it would be a good avenue for us to go to," Andrade told us. But Thomas Bavota says going green left him with regrets. It was here to help homeowners not to hurt thein," Bavota told us. "I never would have gone through this if I had known about the lien." Bavota says a salesperson told him he qualified for $22,000 in financing to install impact windows. He had the windows installed with no problems. But when he tried to refinance his mortgage, he realized the PACE financing for the windows appeared as a lien against his property. He says he wasn't told about that detail ahead of time. I should be able to refinance it and take out whatever money I want, sell it if I want to, just do what we want to do with our house that we worked so hard for," Bavota said. When you finance using PACE, you are signing an agreement with a private finance company that has received approval to operate in your county. A lien is placed on your property until you pay what you owe through a special assessment on your property taxes. Some homeowners in California and Florida say the program was marketed with deceptive" and "incomplete information." A federal lawsuit filed in California against PACE administrator Ygrene Energy Fund claims the lien makes it "nearly impossible for consumers to sell their homes without first paying off the loan and incurring a large prepayment penalty." Ygrene declined an on -camera interview but sent us this statement that says, "Ygrene does not engage in "lending" practices. PACE offers property owners financing to fund energy efficient home improvements, but the transactions are not "loans". Related to the case cited, Ygrene has been and continues to rigorously defend the allegations of this lawsuit. The District Court Judge in the matter has already held that Ygrene's written disclosures adequately advise property owners related to the ability refinance or sell their homes without paying off their PACE financing. Ygrene and the Plaintiffs are currently in the discovery phase of the litigation and Ygrene is confident that ultimately the Court will find all pending claims to he without merit." Ygrene is one of six companies approved to operate through the PACE program in South Florida. I know it's a good program, I know there are a lot of people who have taken advantage of the program, but there are a lot of people who have been taken advantage of also," Miami -Dade Property Assessor Pedro Garcia told us. Garcia says homeowners should contact their mortgage lender to find out how the PACE program will impact them. Check on the interest, check with the company they are recommending you to do that, and checkwith the bank. We asked the company about the Bavota's experience and in a statement they told us, Ms. Bavota interacted directly with a Ygrene representative during the entire process from application to completion and funding of the project. During this time, the homeowner completed application documents, received all program and financing related disclosures', and participated in a "welcome call" to confirm they understood all applicable terms and conditions. You just need to show that you have equity in your home, a good history of making your mortgage paynieiils, and that you make enough money to make payments on the debt. Welcome to Property Assessed Clean Energy financing, a program that has funded improvements for thousands of South Florida property owners over the past three years. Many local governments in the region have approved PACE financing assessments on borrowers' property tax bills as a way to encourage residents to make their homes more energy-efficient and to strengthen them against the effects of storms and climate change. The program has been a blessing for many, providing a means to fund needed upgrades that they couldn't afford relying solely on savings or creditworthiness. But some say they didn't realize what they'd gotten into until it was too late — that a lien would be placed on their home, that they would be expected to repay roughly double the project cost over the life of the loan, and that most banks would require them to pay off the loan in full before they could sell their homes. I understand it was very stupid of me not to read that long contract," wrote Maria Rossello, who lives in a seniors -only condominium with a market value of $37,400, according to the Broward County Property Appraiser's website. In October 2016, she signed an agreement to install three impact windows in the Sunrise condo. Repayment, according to Broward County official records, would cost $639 a year over 20 years. That's on the low side compared with an average PACE loan, but for Rossello, who said she was told she wouldn't be charged interest, it still presented a hardship. The experiences of Rossello and others underscore what experts and customers alike say anyone considering a PACE loan must do: Make sure you read all the paperwork. Read the fine print and make sure you read every bit of that contract," said Scott Nathan, a Pompano Beach resident who borrowed $52,000 for a solar energy system, new roof, new water heater, and solar -powered attic fans. Nathan said he scrolled through loan documents online and missed that the sum of all payments over the 20 -year loan term would be around $97,000. He said his contractor told him that savings on his electric and insurance bills would cover all but $3o a month of the repayment cost. But those savings weren't nearly that substantial, he said, and now his monthly mortgage payments — which include taxes, insurance and his loan repayment installments — are $2,278, instead of $1,556. Nathan said he's not sure he'll be able to keep his home. A typical PACE loan financed through Ygrene Energy Fund Florida runs about 20 years at an interest rate of about 7 percent. Borrowers can expect to repay twice the project cost over the payback period. Complaints about disclosure practices prompted California to enact a law requiring all PACE providers to disclose all project costs, fees, interest rates, annual and monthly payback terms in a simplified document patterned after truth in lending" disclosures required from mortgage lenders in home sales. Another law requires PACE providers to review all terms with borrowers in a live phone call before any financing documents are signed. Ygrene, Renovate America and RenewPACE said they have voluntarily added both practices to their Florida operations. A fourth PACE provider, Florida PACE, did not respond to a request for comment for this story. VDVI I; I I)IN(; Borrowers with excellent credit might pay less by taking out a second mortgage or home equity line of credit, Ygrene senior vice president Mike Lemyre said in an interview on Friday. But for people with modest income, modest savings and modest credit, PACE loans offer good value, he said. Ygrene (spelled Energy backward) is a California-based company that arrived in South Florida ahead of the other companies, getting a head -start in obtaining necessary agreements by Miami -Dade, Broward and Palm Beach counties, and most of the region's cities, to have repayment obligations assessed as part of customers' property tax bills. Since 2013, Ygrene has funded about 15,00o projects in the tricounty region, and doubled its business in Broward and Miami -Dade counties between 2016 and 2017, Lemyre said. The company recruits local contractors and trains them to explain to customers how the Ygrene program works. But while Ygrene and other PACE programs say they constantly review feedback about contractors' performance with their customers, some residents say contractors told them only what they wanted them to hear. Consumer complaints alleging predatory practices by PACE contractors were subjects of warnings by several consumer watchdog organizations in late 2016 and a federal suit seeking class action status filed last spring by plaintiffs in California and South Florida. Manuel Hiraldo, a Fort Lauderdale attorney involved in the lawsuit, said he has been contacted about once a week by unhappy customers seeking to join the suit. Some contractors charge more for projects they know will be financed through PACE, said Hiraldo said. However, Lemyre said he has seen no direct evidence that contractors inflate prices for PACE programs, adding that Ygrene encourages homeowners to solicit competitive quotes just as they would if they were funding a project with cash savings. Would-be borrowers must understand a key part of how PACE financing works, Hiraldo said. "People need to know that a lien will be recorded against their home. That lien can make it difficult, if not impossible, to refinance or sell their home without first paying it off." Early promotions for PACE loans — and even material still circulating today — described the financing as an assessment that stays with the house and not the owner. Because it is recorded with the property's local taxes, the debt theoretically can be transferred with the home to a new owner. That could work if a buyer can afford to pay cash or can swing a mortgage loan not insured by Fannie Mae or Freddie Mac. But Fannie and Freddie, as well as the Federal Housing Administration and the Department of Veterans Affairs, won't insure mortgages with PACE liens because those liens go to the front of the line for repayment if a borrower defaults. Because the federal programs won't insure mortgages on homes with PACE loans, many traditional lenders won't either, meaning the transferability advantage primarily benefits sellers in cash -only transactions, or through specialty lenders. So what happens when a homeowner with a PACE loan wants to sell? Get ready to find a way to pay it off before sitting down at the closing table. For projects financed before the third quarter of 2017, Ygrene charges a prepayment penalty of 5 percent of the balance of the debt. That penalty was discontinued late last year for new customers only, Lemyre said. Customers have also complained of being charged $loo just to learn the payoff amount of their loan. Lemyre said the $loo fee was collected by a third - party administrator hired to record transactions and get them on local tax rolls. Recently, Ygrene negotiated the fee down to $5o per inquiry, he said. Markisha Collins, who with husband Johnny Collins Jr., used Ygrene to finance installation of impact -resistant windows and doors in 2016, said they weren't made fully aware that their PACE financing showed up as a lien against their property until getting a phone call from the title company involved in the upcoming sale of their house. It added a major complication to their sale efforts, she said. She recommends that homeowners use PACE only if they know they plan to stay in their house for the length of the payback period. If you're going to be in your home for a lifetime, do it, by all means," she said. The new impact windows and doors undoubtedly enhanced the value of the 1,10o square -foot home the couple bought for $6o,000 in early 2016 and now plan to sell for well over $1oo,000. FLACP is a nonprofit, nonpartisan enterprise whose mission is to advance consumer protection and tenant rights through research, education, and advocacy. We will provide information, below, to the major headings for which you requested comments. Overall, our experience in Florida is many homeowners have suffered under the PACE program for two major reasons: a failure by the third party administrator or contractor to make any determination if the homeowner has the ability to repay the PACE loan; and, contractor overreach, poor construction, and outright fraud leading to problems for the homeowner. Florida residential PACE program was created by state law in 2010. State law allows for local governments, as defined in the law, by ordinance or resolution, to create a PACE program. Residential PACE was slow to start in Florida due to legal challenges to the law, including one by the Florida Bankers Association over the super lien created for PACE loans. The Florida Supreme Court dismissed the case for lack of standing in 2015, and the PACE program began to grow after that. I. Current Standards in PACE financing Ability to repay lacking in Florida law (Question 1). Florida statutes at 183.08(9) requires: Before entering into a financing agreement, the local government shall reasonably determine that all property taxes and any other assessments levied on the same bill as property taxes are paid and have not been delinquent for the preceding 3 years or the property owner's period of ownership, whichever is less; that there are no involuntary liens, including, but not limited to, construction liens on the property; that no notices of default or other evidence ofproperty -based debt delinquency have been recorded during the preceding 3 years or the property owner's period of ownership, whichever is less; and that the property owner is current on all mortgage debt on the property. These provisions only provide protection to the lender, whether local government or third party administrator. They provide no protection to the property owner. Further, no jurisdiction in Florida has a true ability to repay (ATR) requirement. This lack of ATR is problematic because these loans are marketed as government loans with only two requirements: 1) you are current with your mortgage and 2) are not currently in bankruptcy. Lack of underwriting and adequate approval (Question 2 and 3): Any underwriting requirements would be established either by ordinance or a memorandum agreement between local government, special district or interlocal agreement and a third party administrator. No ordinance, to our knowledge, provides an ATR meeting the TILA requirements. Our experience is that each and every person we have spoken with were subject to no underwriting and credit reports were not accessed. In fact, the contractors handle the loan application and approval process during the first hour or two of the initial visit with the borrower, knowing that if there is a problem with the lender accepting the documents later the contractor can still file a foreclosure lawsuit against the homeowner for a mechanic's lien. Homeowner's are also told by the PACE financing companies that the contractor salesperson is responsible for explaining the nature and amount of financing and remedies if the contract is not met. The sales people are not equipped with the knowledge to do so and also spend the entire time with the potential homeowner client trying to upsell products and services. The homeowner is told they must sign an electronic screen on a cell phone, tablet or in some circumstances a lap top computer for a "credit check." However, review of credit reports and the absence of any passage of time between the first visit and the start of construction) shows the reports were not consulted. Instead the electronic signatures are transferred without the consumer's knowledge to a home improvement contract, loan documents, notices of commence and even notices of completion. Construction contracts also state that if the work starts before the three-day rescission period has elapsed then this three right of rescission is null and void. PACE Providers, as selected by each local government, special district or interlocal agreement, determine who is eligible to enter into a financing agreement. The PACE Providers determine the financing terms. However, it appears the financing "decisions" and determining eligibility is generally approved almost instantaneously with the first visit by the contractor leaving the PACE provider out of the loop. Many consumers do not know they have a loan until well after the improvements or attempt at improvements have been made. Information provided to consumers (Questions 4 and 5): There is no state law requirement and thus no uniformity in Florida about requiring PACE providers to disclose project costs, fees, interest rates, and annual and monthly repayment terms in a simplified document. Consumers report that they never have any contact with the lender until after the improvements are completed and did not even know they were being approved by a third party for a loan. There are no disclosures of any type given relating to the financing agreement. They are also learning, much later, that the FTC Preservation of Claims and Defenses Rule does not apply. 16 C.F.R. §433. Therefore, when the construction materials are not provided, do not work, are not properly installed, some homes even being damaged in the process, they have no recourse against the creditor. The lenders have abdicated their responsibility to explain the cost of credit and other financing details to the contractor sales people. The sales people do not have the time or information to explain this complicated financing structure. Further, consumers are not given an estimate of costs and are not given final amount assessed until after the work is completed. Contracts claim that if the provision of services/materials takes place before the cost of credit and explanation of credit terms are provided, these consumer protections are waived. They are not told that the loan creates a lien on their home nor that it will be a special kind of lien. They are not told how much they are borrowing, how much interest they are being charged or any other cost -of -credit information before the loan is final. They are also not warned of the consequences of non-payment. The actual documents and cost and other information is provided by the contractor after the work is complete. The creditor only comes into the picture well after the contractor has left, job complete or not. Often false work completion certificates are created and forged by the contractor. Role of state and local government in originating, underwriting and financing obligations Questions 6 and 7): State law provides that local government is responsible for originating, underwriting, and financing obligations of PACE loans. Local government, pursuant to state law, may delegate this role by ordinance or resolution, to third party administrators. Generally speaking, the initial financing contract is with one of the PACE lenders/third party administrators. Relationship between PACE financing agreement and the home improvement agreement Question 8): There are always two contracts, one for the home improvements and one for the financing. Both types of contracts are governed by the Florida Home Improvement Sales and Finance Act, Chapter 520, Part V. Unfortunately, neither the contractors nor the creditors follow these laws. They appear to think they are exempt. If in the contractor's haste to consummate the loan (and the home improvement contract) it creates a loan that the PACE provider will not accept, the contractor just sues to take the consumer's home in foreclosure based upon Florida mechanic's (construction) lien laws. Chapter 713, Part I, Fla. Stat. More often than not these foreclosure lawsuits are filed against homeowners who cannot afford an attorney and whose home is in worse condition than when the contractor showed up to tout the PACE program. III. Civil liability under TILA for violations of ATR requirements in connection with PACE financing, as well as rescission and borrower delinquency and default Rescission rights (Question 12): State PACE loan law provides for no rescission rights for the borrower. Further, borrowers are not provided with the federal Truth in Lending rescission remedy. The financing contract may provide for a three-day cooling off period as required by our home improvement sales and financing act for the home improvement contract or the financing contract. §520.72, Fla. Stat. Unfortunately, because homeowner's do not see the financing contract until weeks, often months after their signature is electronically forged on a financing contract this right has been lost. The failure to provide copies of the home improvement and financing contract happens with such regularity that it is clear the contractor does not want the borrowers to know they have the right to cancel. Work begins immediately, so even if the borrower has a copy of the contract, it is too late to stop the contractor from acting against their best interests. The three- day cooling off period is provided to every consumer in every other kind of home improvement and home improvement financing contract, even contracts which do not provide such serious and life -altering remedies as the PACE loans provide upon default. Obligations after delinquency or default (Question 13): If property owner has a mortgage and the mortgagee is escrowing the property tax assessment, the property owner would be subject to the usual Florida foreclosure procedure for failure to pay his or her mortgage if they become delinquent on the mortgage payments because of an increase in the monthly mortgage payment to cover the increase in the monthly escrow amount. Borrowers who become obligated on PACE financing find their monthly mortgage escrow payments (added to the monthly principal and interest) skyrocket to unaffordable levels leading to foreclosure. If the property owner is paying his or her taxes directly to the local property tax collector, then the process would follow state law for imposing a lien for failure to pay the tax assessment. Neither state nor federal law provide a loss mitigation program. IV. Features of PACE financing that make it unique and how the Bureau should address those unique features Financing options for PACE (Question 14): Florida PACE Funding Agency — AllianceNRG Program Ygrene Energy Fund Florida Greenworks Lending PACE Funding Group, LLC Renew Financial Renovate America Solar and Energy Loan Fund Consumer repayment (Question 17): Consumer payments are made through the tax payment process with the local tax assessor. However, if there is a mortgage on the property owner's property, payments would be made by the mortgagee. The mortgagee would require that the property owner increase their monthly mortgage payment to cover the increased cost of the taxes. These amounts are held in escrow by the mortgagee until the tax payment becomes due. State law provides at 163.08(4), Fla. Stat.: Subject to local government ordinance or resolution, a property owner may apply to the local government for funding to finance a qualifying improvement and enter into a financing agreement with the local government. Costs incurred by the local government for such purpose may be collected as a non -ad valorem assessment. A non -ad valorem assessment shall be collected pursuant to s. 197.3632 and, notwithstanding s. 197.3632(8)(a), shall not be subject to discount for early payment. However, the notice and adoption requirements of s. 197.3632(4) do not apply if this section is used and complied with, and the intent resolution, publication of notice, and mailed notices to the property appraiser, tax collector, and Department of Revenue required by s.197.3632(3)(a) may be provided on or before August 15 in conjunction with any non -ad valorem assessment authorized by this section, if the property appraiser, tax collector, and local government agree. Energy savings (Question 21): State law does not require calculation of energy savings. We have had reports from consumers that instead of savings their energy bills increase because the materials and labor are substandard, in some instances the bills are much worse or the equipment does not work at all because it is the wrong equipment, was improperly installed or not installed at all. Impact to consumers' ability to meet financial obligations (Question 22): Many property owners have faced losing their homes because of the increase in their tax assessments in an amount they could not afford. For example, a retired beautician in central Florida saw her annual tax assessment triple. This caused an increase in her mortgage escrow and monthly mortgage payment from $288 to $600. She fears she will lose her home because of the financial strain this increase has on her fixed income. Her PACE loan was financed through Ygrene and she was assured the loan would not affect her mortgage. She now owes over $14000 at 7.88% for a new HVAC unit that is not working properly since installation. PACE liens (Question 23): A PACE tax assessment lien is treated no differently than any tax assessment lien. It is added to the property owner's non -ad valorem tax assessment. Additionally, Florida homeowners are subject to construction liens if they fail to pay contractors for improvements. If the PACE loan falls through at origination because of contractor origination error the borrower is subject to a construction lien or "equitable" foreclosure. Further, many PACE loan financers tout that homeowners are protected by a requirement that the homeowner must certify the repairs are adequate before the contractor will be paid. In some cases, this has resulted in the homeowner being subject to a construction lien. Mortgage escrow accounts (Question 24): The property owner's PACE non -ad valorem tax assessment is added to the mortgage escrow account, thus causing an increase in the homeowner's mortgage payment. Since the mortgagee, by state PACE law, receives notice of the pending PACE loan, triggers the servicer to increase the escrow fee due each month accordingly. Here is state law: 163.08(13) At least 30 days before entering into a financing agreement, the property owner shall provide to the holders or loan servicers of any existing mortgages encumbering or otherwise secured by the property a notice of the owner's intent to enter into a financing agreement together with the maximum principal amount to be financed and the maximum annual assessment necessary to repay that amount. A verified copy or other proof of such notice shall be provided to the local government. A provision in any agreement between a mortgagee or other lienholder and a property owner, or otherwise now or hereafter binding upon a property owner, which allows for acceleration of payment of the mortgage, note, or lien or other unilateral modification solely as a result of entering into a financing agreement as provided for in this section is not enforceable. This subsection does not limit the authority of the holder or loan servicer to increase the required monthly escrow by an amount necessary to annually pay the qualifying improvement assessment. Additional information (Question 25): Borrowers are not provided the pre -consummation, cost -of -credit information required by TILA and state law (Chapter 520.73, Fla. Stat.); are not protected by 16 C.R.F. 433 (FTC Preservation of Claims and Defenses Rule; have no protections similar to those provided in 12 C.F.R. 1024.41 (Regulation X, Loss Mitigation) V. Potential implications of regulating PACE financing under TILA (this seems to be a section we should focus on — I have written Michael Best about any template answers that might be available — at least so we can be consistent nationally.) Benefits of ATR requirements in TILA and Regulation Z (Question 27) First, we would argue that the requirements already exist. Making these protections clear would provide consumers the assurance that an ATR requirement will help prevent entering into financing arrangements that the consumer subsequently cannot afford, thereby putting their homeownership at risk. A home is by far the largest purchase most consumers will make in their lifetime and thus, these protections should be clear and unequivocal. Specific ATR provisions under TILA and Regulation Z (Question 30): The ATR concept is essential to the PACE loan process. The stakes in these types of loans are the same if not higher than any type of consumer credit including residential mortgage. ATR requirements are the bare minimum for any type of consumer credit. The ATR standards for lenders to meet are a bare "reasonable and good faith" determination of a borrower's ability to repay. The documents required have historically been required by all types of lenders from motor vehicle finance companies to mortgage lenders. The only time over the last several decades when inflated "no document" loans flooded the market, the crash of 2008 occurred. The following are the minimal requirements which should be applied to PACE loans: A review of *consumer's credit history and present and anticipated income other debt and debt and income ratio (residual income) employment status and other sources of income Because the repayment schedule requires steep payments as a result of the lack of frequency of payments and because the stakes are high — the potential for loss of one's home, this information is a crucial part of underwriting. The requirement that the loan is not based upon the equity in a potential borrower's home is also crucial. Any loan which is not based upon a consumer's ability to pay has all of the hallmarks of a predatory loan and has caused fraudulent practices among illegal contractors, licensed and unlicensed, who say they will provide materials and services and then get their checks and leave the county. The lenders are far removed from the actual construction and do not monitor the contractors they allow to access the loans. Providing loans based only on the amount of equity in a borrower's home is a sure sign that foreclosure will be imminent. Tailoring of existing TILA ATR requirements (Question 31 and 32): There requirements referenced above would not require any tailoring of the ATR statutory provisions or regulations. The only potential effect it would have on the contracting and origination process would be that the contractor would be less able to start work before financing is established. Contractors are already required by Florida law to allow a three-day cooling off period, unfortunately PACE contractors ignore this requirement. In ordinary second lien financing this practice would be called "spiking" and is a trademark of a predatory loan. These requirements would mean that fewer consumers would find themselves in loans they clearly cannot afford and fewer consumers would find themselves homeless. Application of other provisions (Question 33): Consumers should be entitled to receive the cost -of -credit information prior to consummation. More accurately, consumers should also receive the HOEPA disclosures required three days prior to execution of a loan so they understand the amount and timing of payments, APR and, particularly that they run the risk of losing their home and all of the equity established in their home. They should also receive the materials disclosures with the right of rescission as a remedy when not provided. Property owner stories of problems with PACE loans in Florida: Client 1: Contractor inspected property owner's roof for free. Quoted $5000 to fix"/replace roof under a "Government Program with zero interest and no payments until 2019. Contractor had property owner sign and initial form on a mobile device. Since the home was titled in both property owner's name and his former wife, Contractor requested property owner forge his wife's initials and signatures on the mobile device and DocuSign. Property owner refused and obtained his former wife's approval and signature. Property owner found out that he was charged almost $13000 for the roof repair when he went to investigate why his property tax bill had increased significantly. Client 2: Property owner had a leak in his skylight but no other roof leak. Contractor inspected the skylight and roof and quoted $13,000 to replace roof with zero interest under a government program that would not require payments until 2019. He was asked to sign on a mobile device and could not adequately read the documentation. He read none of the documentation but trusted the contractor since it was a "government program." Client 3: Property owner's HVAC system was 7 years old and was not working properly. Contractor state that Ygrene was a government program that would allow him to purchase a new HVAC for zero interest with payment over a 10 year period. Contractor told him that the cost of the HVAC through the government program was $13,000 and that it would include a 10 year maintenance for the life of the HVAC. Residential property is 1100 square feet. Property owner did not question the price or the terms assuming that the government program provided fair and just process. He found out he owes approximately $25,868 (principal and interest on a 20 year term at 7.49% interest) when he received his property tax bill and noticed an increase of 1293.41. He had not shopped around for other vendors assuming that a government program would provide him the best terms. Client 4: About two months after Hurricane Irma, representatives from Ygrene, or people who identified themselves as representatives of Ygrene, were knocking on all the doors in property owner's neighborhood. In this case, the Ygrene representative was in her late 30's or early 40's. She said that Ygrene PACE as a Government of Florida Program that was there to help property owners recover from Hurricane Irma. Therefore, he trusted her. Property owner had a tarp on the roof and the AC had been ripped out. Property owner was concerned about mold. The Ygrene representative said she would contact the contractors/vendors directly and property owner did not hire the company directly. Property never spoke directly to the contractors. The Ygrene representative had shingle samples and AC brochures with different model ACs. She said she had all the Ygrene government forms, that there were no payments for a year, and zero to very little interest. Everything was done electronically so he could not really read the contract. The same Ygrene representative came to his house two times. Property owner is still unsure of who did the work on his home. Client 5: Representatives that said they were from Ygrene knocked on property owner's door. Bruce from Ygrene Florida State Corridor came to her home and said he was the representative of a government program that was there to help after the hurricane. Half of property owner's roof had been lifted and damaged. Email property owner received from Bruce listed him as Bruce Wayne with Ygrene Florida State Pace Program, but the company was Summitwood Works. But he told property owner he was from PACE Green Program which was a government program. She signed the documents on a mobile device and was told a contractor would be arranged. Bruce told her the total for her roof was $8192 (of which $2000 should have been deducted as it was paid directly to him by Red Cross). She was told by Bruce the remaining amount would be deducted from her mortgage escrow at the end of the year at zero interest for five years. When she received her property tax bill, she realized that she could not afford the amount and had to refinance her home for another 30 years to be able to afford the new debt. Her previous mortgage had three years remaining. Client 6: Contractor came to her home and gave the homeowner an estimate and during this same meeting told consumer he was pulling her credit to see if she qualified for a PACE loan and/or another type of financing. She electronically signed her signature on a cell phone authorizing a credit check only. She agreed verbally to a $6,700 duct system for her home. The improvements were sloppily made and incomplete. The "new" system did not work and according to the County Inspector the new wiring looked like spaghetti. The contractor failed to properly complete the financing documents and filed a Claim of Lien in the amount of 20,450.00. The contractor forged the borrower's name on the Notice of Commencement. He also had the document notarized well after he left the home. The repairs started before financing was arranged. Several of the other transactional documents were notarized, there was never a notary present. The consumer is being sued for foreclosure as a result of a claimed mechanics' lien. The work was commenced without a permit and began immediately after the cell phone signature was provided. Client 7: An air conditioning system was partially installed without a permit, the Notice of Commencement was never signed by the consumer. The sales representative for the contractor refused to disclose the amount the PACE program lender had agreed to lend. The consumer's credit was pulled without his permission which decreased he and his wife's credit scores. They never applied for credit with the eventual lender, GreenSky and never signed any loan documents with GreenSky. The contractor's sales representative forged the consumer's names onto the loan documents and then unilaterally contacted the lender to authorized draws from the credit to itself. The total amount charged was $38,745.00. The lender agreed the materials and services were incomplete but will not work with the consumers regarding their very inflated loan. Client 8: Client is over 60 and not familiar with home improvement contracts or loan. The contractor started the project before the consumer agreed to sign a financing contract. After she was given the total cost of the project and did not agree to pay, the contractor said they could not put the old equipment back in and threatened that she'd be left without air conditioning in South Florida. The consumer felt she had no choice but to let them continue the substandard work. She still has not signed the home improvement contract but is obligated to pay $20,000 through her property taxes.
