CALL TO ORDER: Mayor Glasser called the meeting to order at 6:30 PM. City Clerk Bartle called the roll. Approve minutes of the Regular Commission Meeting on December 9, 2019. 1 B. Approve minutes of the Regular Commission Meeting on January 27, 2020. 1 C. Approve minutes of the Commission Workshop on December 9, 2019. Mayor Glasser asked if there were any corrections or changes needed. There were no corrections to the minutes. Mayor Glasser stated the minutes stand as submitted. 2 COURTESY OF FLOOR TO VISITORS 2A. Proclamation for Government Finance Professionals Week Mayor Glasser read the Proclamation into the record and presented it to COAB Finance Director (FD) Melissa Burns and Deputy Finance Director Brittany Percell. Regular City Commission March 9, 2020 PUBLIC COMMENT Mayor Glasser recognized former Mayor Mitch Reeves who was in attendance. Mayor Glasser explained the process for public comments and opened the Courtesy of the Floor to Visitors. City Clerk Bartle called each speaker to the podium. Lynn Drysdale spoke in opposition of Item 3A. Property Assessed Clean Energy PACE) program. She referred the Commission to a case study in Collier County, Florida and also submitted handouts of material provided to the Consumer Financial Protection Bureau. Don Ford spoke in support of Item 3A. PACE program. PACE plans have been around since 2001, first one in the City of San Francisco. If done and monitored properly it is very worthwhile. He requests the Commission to continue to gather facts and move forward with the Resolution. Sarah Boren spoke in support of Item 3A. PACE program. She shared success metrics, and stated she will also provide them to Commission via email. Ann Marie Moquin spoke in support of Ordinance No. 95-20-118 and wishes to continue discussions to eliminate single -use plastic in COAB facilities. Taryn Montgomery spoke in support of Ordinance No. 95-20-118 and in support of removing single -use plastic from COAB facilities. Mitch Reeves spoke in support of Item 3C., Sign Code, provided background regarding the Sign Code and is in support of Ordinance No. 95-20-118. Paula O'Bannon, event Chairman, spoke about the Tour de Parks event and thanked staff and Mayor Glasser for their assistance. Nicole de Venoge spoke in support of Ordinance No. 95-20-118, is in support of education and providing alternatives to balloon releases, encourages people to go visit www.balloonsblow.org. Regis A. Garcia spoke in support of Item 3.A. PACE program. As a local PACE funding group representative, spoke on the company as being very regulated, ethical, and very selective of people we hire. Upfront with project costs, APR rates, and how it's done; contract shows all details. Nancy Garcia spoke in opposition of Item 3.A. PACE program. On behalf of Northeast Florida Association of Realtors, spoke regarding issues with the program and provided a handout which included concerns. Asked Commission to consider the adverse effects when reviewing the program. Mayor Glasser closed Courtesy of the Floor. Regular City Commission March 9, 2020 3 CITY MANAGER REPORTS 3A. City Manager's Report CM Corbin reported on the following: As a Leadership in Energy and Environmental Design (LEED) certified City, we are looking at opportunities to increase energy efficiency and be more environmentally friendly. CM Corbin stated the agenda packet includes a PowerPoint sent to us by PACE; which outlines the program. 18th Street beautification project launched with public meetings continuing through May. Eagle Scout project "bat condo" on the southern point of Dutton Island is going to the Environmental Stewardship Committee (ESC) for their consideration this month. Corona Virus discussions with City of Jacksonville and Health Department. Requests confirmation of Commission members attending the Opening of the Beaches Parade, April 26, 2020. April 20 tentative joint Commission workshop with ESC to discuss proposed Tree Code revisions. Mayor Glasser spoke regarding calendar items; she asked if the Town Hall on April 4, 2020 was on the calendar and questioned whether there was consensus to hold an Open House in the Marsh Oaks Business District on the Comprehensive Plan. Discussion ensued regarding a tentative Open House on April 9, 2020 regarding the proposed bike park. CM Corbin to take under advisement and provide better dates. 3B. Accept the 90 -Day Calendar (March through May 2020) There was CONSENSUS to accept the 90 -Day Calendar contingent upon rescheduling the March 19, 2020 Commission Workshop and the April 9, 2020 Open House. 3C. Sign Code CM Corbin spoke about the history of the Sign Code and the intent of the City to come into compliance with Federal Law. He gave an overview of the items which are provided in the agenda packet. Discussion ensued about proposed changes, the need for community input and the visual preference public survey available for citizens at City Hall. CM Corbin invited citizens to contact staff for one-on-one review of the proposals. Community input will be used to create a presentation at the April 4, 2020 Town Hall. 4 REPORTS AND/OR REQUESTS FROM CITY COMMISSIONERS 4A. Orlando Recycling Ordinance (Mayor Glasser) Mayor Glasser spoke about the Commission's priority to promote plastic reduction measures, and to promote the four R's (Reduce, Reuse, Recycle). She spoke about an Regular City Commission March 9, 2020 Ordinance passed in Orlando, which is included in the agenda packet. She referred to a list of commercial business receiving trash collection in Atlantic Beach noting a majority of businesses do not have a recycling plan. She requested feedback from Commissioners on a feasibility survey of COAB businesses to determine whether a recycling program could be implemented in the future. She suggested filling a Planning Department vacancy with a position to address environmental sustainability and creating a recycling program for commercial businesses. Discussion ensued regarding concerns of requiring businesses to recycle, when many items thought recyclable are not, incentives to participate, possible consideration for COAB to place a receptacle for cardboard, tiered implementation of a program and the need to fill the position in the Planning Department. There was agreement for staff to further research and bring back for more discussion. 4B. Single -Use Products on City Property (Mayor Glasser) Mayor Glasser requested continued discussion on establishing policies for In -House Guidelines on City property regarding single -use plastic. She suggested an inventory of items to purchase for use in- house by staff, then continuing to our event spaces. She referred to language in the Orlando Ordinance, which is included in the agenda packet, for use in preparing COAB guidelines. There was agreement to move forward in preparing guidelines for in-house use of single -use products. Commissioner Kelly Read citizen emails received this week regarding the Paid Parking program, Seminole Road improvements, Waters Park fence design, Sign Code, and Mayport Road improvements. The City Pension Fund will not meet this year's goals and suggested looking for alternative ways to contribute. Commissioner Norris Requested a date for review/discussion on the Paid Parking program. Received an email from a citizen regarding concerns with Mayport Road improvements. Mayor Glasser Special thanks to Paula O'Bannon for chairing the successful Tour de Parks event, Recreation Department Timmy Johnson and Carina Reyes and all who assisted. Attended the U.S. Green Building Council's annual awards ceremony with CM Corbin where he received the Innovative Project of the Year award for our LEED for Cities certification. Good job to staff. Regarding the email about concerns with Mayport Road, have asked CM Corbin to create a project page with studies that support the improvements. 5 UNFINISHED BUSINESS FROM PREVIOUS MEETINGS None. Regular City Commission March 9, 2020 6 CONSENT AGENDA None. 7 COMMITTEE REPORTS 7A. Environmental Stewardship Committee (ESC) CM Corbin introduced ESC Chairman, Tony Pooley, who presented a summary report on ESC progress. Mr. Pooley presented a PowerPoint, Accomplishments of the Environmental Stewardship Committee, included in the agenda packet that highlighted the 2019 priorities of the committee. He spoke about the ESC goals and themes for 2020. Mayor Glasser congratulated Mr. Pooley for his nomination as one of the Green Hero/Champion of the Year by the U.S. Green Building Council (GBC). Mr. Pooley stated he recently obtained a Global Sustainability degree and is currently employed as an Environmental Services Consultant. He is committed to sustainability as an integral part of the future for COAB. Mayor Glasser requested a Tree Ordinance update from the ESC and requested the ESC support and contribute to the City's environmental projects. CM Corbin proposed April 20th for a joint workshop with ESC and City Commission. 7B. Board Member Review Committee's Recommendation for Appointment to the Cultural Arts and Recreation Advisory Committee (CARAC) (Commissioner Norris) Commissioner Norris stated there are two vacancies (one regular and one alternate) on CARAC. She highlighted the accomplishments of Mr. Gonzalez and stated that the BMRC requests the Commission to appoint him to the regular unexpired term to begin immediately going through December, 2021. MOTION: To appoint Mr. Gonzalez as a new regular member to fill the unexpired term on the Cultural Arts and Recreation Advisory Committee beginning immediately and ending December 31, 2021. RESOLUTION NO. 20-13 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AUTHORIZING THE CITY TO ENTER INTO THE 2018-2019 JUSTICE ASSISTANCE GRANT DIRECT PROGRAM. Mayor Glasser read the Resolution by title. Chief Gualillo reported that the 2018-2019 Justice Assistance Grant (JAG) is approximately $3200 and will be used to replace the communication equipment for the COAB motorcycle officer. ORDINANCE NO. 95-20-118, Public Hearing and Final Reading AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, FLORIDA, AMENDING CHAPTER 5 OF THE CODE OF ORDINANCES, BEACHES AND PARKS, BY AMENDING SECTION 5-4, LITTERING, ADOPTING NEW SECTION TO PROHIBIT THE OUTDOOR RELEASE OF BALLOONS AND SKY LANTERNS; PROVIDING FOR ENFORCEMENT AND PENALTIES;AND PROVIDING AN EFFECTIVE DATE. Mayor Glasser read the Ordinance by title and opened the Public Hearing. City Clerk Bartle read the names and invited the following to speak: Ann Marie Moquin spoke in favor of Ordinance No. 95-20-118 and praised the awareness it would bring to this issue. She spoke about a 2019 University of Michigan study regarding animals and ingestion of plastics. Maria Fann spoke in favor of Ordinance No. 95-20-118. She provided history of the Surfriders Foundation petition and signatures in support of a balloon ban. She spoke about a September 2019 Washington Post article about an experiment regarding Regular City Commission March 9, 2020 balloons traveling a great distance. Jim Walker spoke in favor of Ordinance No. 95-20-118 and urged the Commission to be bold in its decisions in protecting the environment. Mayor Glasser closed the Public Hearing. Commissioner Norris - in support of the Ordinance, shows how serious COAB is in being an environmental leader. There are more creative, long term ways that people can celebrate or recognize events and special moments. Mayor Glasser thanked speakers and the media for covering this. Spoke about being approached about a balloon release ban, enforcement and the reason for the Ordinance. We are not anti -balloon, but they need to be popped and put into the trash can, not released into the air. ORDINANCE NO. 75-20-23 Introduction and First Reading AN ORDINANCE, AMENDING THE CODE OF ORDINANCES, CHAPTER 21, TRAFFIC AND MOTOR VEHICLES, ARTICLE II — STOPPING, STANDING AND PARKING ON PUBLIC PROPERTY, SECTION 21-17 PROHIBITED IN SPECIFIC AREAS; PROVIDING FOR CONFLICT, FOR SEVERABILITY, AND FOR AN EFFECTIVE DATE. Mayor Glasser read the Ordinance by title. CM Corbin provided background as detailed in the staff report included in the agenda packet. A brief discussion and questions ensued. Chief Gualillo responded and explained that the language change will not alleviate school traffic, but allow a police officer to enforce under State Statute. Mayor Pro Tem (Mayor Glasser) Mayor Glasser spoke regarding the duties of a Mayor Pro Tem as listed in the City Charter. Mayor Glasser expressed wishes to extend the position to Commissioner Norris. She acknowledged Commissioner Norris's leadership roles and commitment to serve. MOTION: To appoint Commissioner Norris to Mayor Pro Tem effective immediately. Motion: Cindy Anderson Second: Candace Kelly Cindy Anderson (Moved By) For Candace Kelly (Seconded By) For Ellen Glasser For Brittany Norris For Motion passed 4 to 0. 11 CITY ATTORNEY/CITY CLERK REPORTS AND/OR REQUESTS CA Durden - The 2020 Florida Commission on Ethics Guide to Sunshine Amendment and Code of Ethics has been published. 12 CLOSING COMMENTS BY CITY COMMISSIONERS AND CITY MANAGER Commissioner Anderson - Spoke about a recent trip to Tallahassee and the beautiful lights in the trees in the downtown square, has asked CM Corbin about installing LED lights in the trees in Russell park to illuminate and provide a welcoming ambiance. CM Corbin reported we are looking into changing the location of the flashing crossing signal from the intersection of Sea Spray Avenue and Sailfish Drive to the crosswalk by the tennis courts that go to Howell Park. Other flashing signs on Plaza would allow travel from Howell Park through Russell Park crossing Plaza and connecting to the Safe Routes to School Path. CM Corbin also stated that he welcomed input regarding the Sign Code.
