Hi Doug,
Doug L. & I looked over the easement documents. I see you already
include the area where the water main is serving the fire hydrant, so
that item is taken care of.
The proposed easement verbiage states “an unobstructed right-of-way and
easement (provided, however, Grantor shall be allowed to locate other
improvements into the City of Atlantic Beach Easement as described on
the attached Exhibit A) . . .”
Looking at Exhibit A (the Dutton Island Entrance private road), I don’t
see anything about the “other improvements,” though I believe this would
refer to the statue and possibly the gate.
The wording needs to be changed to say “an unobstructed right-of-way
and easement (provided, however, Grantor shall be allowed to locate
other improvements into the City of Atlantic Beach Easement “that do not
affect the Grantee’s ability to improve or maintain its facilities.)”
