Rick,
I agree with them too, but the rule still stands and with an audit around the corner I cannot withdraw my report.
The NOI clearly states that All silt fence will be installed prior to construction. I have yet to see the permit. This letter is not acceptable and I will need a more entailed letter
from the Engineer of record stating HE will take full responsibility for any Erosion Control issues that arise out of the non-compliance with the DEP rules or until BARCO has completed
all items on the erosion control report.
If they would like we can meet with the field rep for DEP and get this blessing in writhing to amend the permit which would be fine..

I will require a signed letter from the Engineer of record to change anything deviating from the approved plan as shown. If these FDEP requirements are not met ASAP I will have no choice
but halt all dirt work till they are satisfied. We have been very lenient as of this date. Nothing should have been done the last two weeks till all silt fence was properly in place
and inspected by COAB per the permit.

At my meeting with Mark Lyon today , he stated the following reasons for his no answers & Barco’s rebuttal was as follows:
#2 – ALL silt fence shown on the plans is not installed - Barco sees no need to install silt fence along Dutton Island Drive until construction of Dutton Island Drive begins, Barco
sees no reason to install silt fence at Linkside Pond # 2 until after it is expanded as long as we maintain a 50 ft undisturbed grassed area along top of bank, Barco sees no reason
to install silt fence along Sherman’s Creek that will be destroyed by the retaining wall contractor & Barco sees no reason to install silt fence along the balance of Sherman’s Creek
now that it has been designated “A Ditch” by SJRWMD We will maintain a 50 ft undisturbed grassed area along the “ditch” for as long as possible.
#3 – All disturbed areas are not properly stabilized. Barco can not be expected to stabilize every disturbed area unless it creates a turbid off site discharge. We currently have a series
of ditches connecting the existing Ponds together & are attemting to direct all water flow to one of those ditches/ponds.
#5 – All Construction entrances were not build when report was written but the Dutton Island Entrance has now been constructed. Barco does not intent to build a construction entrance
at the club house until we start construction. The entrance Realco is using is an existing asphalt driveway.
#7 –Existing Inlets along Dutton Island Drive are unprotected. Barco sees no need to protect the inlets until we start construction.
#8 – Storm Water Ponds & conveyance systems are not stabilized & free of sediments. Barco has not stabilized the dewatering ditches but has installed 2 ea Silt Barriers & a concrete
check dam just before the outfall ditch enters Sherman’s Creek. To date all dewatering has been by gravity lowering of the water in the existing ponds & has created no turbidity.
#10 – Sediment traps have not been installed. Barco maintains none have been needed other than as described in the previous answer.
#11 – All stockpiles are not adequately stabilized . Barco agreed to place silt fence on the creek side of the one Cart Path Concrete Stockpile just south of the existing maintenance
bridgewithin the 50 ft buffer.
Doug – We need Alex to concur with Barco’s position on Silt fence along LS#2 , Sherman’s Creek & Dutton Island Drive. As long as it is shown on the drawings, COAB expects it to happen.
