There is an application fee of $250 for the request. The copula and Tower Lantean may be considered architectural features that are not habitable and may be granted a height variance. Note: the measurement of our maximum height is determined from the established finish grade if not located within a flood zone. The elevations show the height may be measured from the finish floor. Mike G. Sec. 59. - Zoning, land development regulations and maximum building height. Zoning and land development regulations shall be in accordance with Florida Statutes or as otherwise provided for within the Code of Ordinances, except that in no case shall the maximum height of buildings within the City of Atlantic Beach exceed thirty-five (35) feet; provided however, that existing buildings which exceed thirty-five (35) feet in height may be repaired to that existing height, no alterations shall be made to any building, which would cause that building to exceed thirty-five (35) feet in height, and this Charter provision shall not restrict any property owner's vested rights under constitutional, statutory or common law. Further provided, however, that the city commission may approve, pursuant to the applicable section of the city's land development regulations, requests to exceed the maximum building height of thirty-five (35) feet for exterior architectural design elements, exterior decks or porches within nonresidential land use categories as designated by the future land use map of the adopted comprehensive plan, for nonresidential development. The only property excepted from this height limitation shall be certain parts of the existing Sea Turtle Inn hotel property, located at 1 Ocean Boulevard, Atlantic Beach, Florida, which property is bounded by Ahern Street on the north, the Atlantic Ocean on the east, Atlantic Boulevard on the south, and Ocean Boulevard on the west, and only those parts of said property as follows: (1) The existing buildings that exceed thirty-five (35) feet on the property as of the effective date of this ordinance; and (2) That part of said property extending west from the existing hotel tower no more than one hundred twenty-five (125) feet towards the west property line, no closer than fifty (50) feet to the south property line, with no more than a maximum width of one hundred (100) feet and containing an additional footprint of no more than eleven thousand five hundred (11,500) square feet. However, any future development, redevelopment or expansion on these parts of the property, which are proposed to exceed thirty-five (35) feet in height shall be subject to approval by the city commission and shall in no event exceed the height of the existing hotel tower building as of the effective date of this ordinance. Would appreciate feedback on how to handle the request. Secondly TR Hainline provided another draft copy od the "master" agreement with AB. You and I had discussed some issues with the specific part concerning re-use water rate charges and Mike Carlin authorized me to send the below as draft language for consideration: Atlantic Beach will establish and amend in the future as needed volume based rates for sale of reuse water for all customers of the reuse system. Because of the terms and conditions in this Agreement, and in consideration of the Conservation Easement and Agreement towards Annexation to be provided to Atlantic Beach, and Atlantic Beach's commitment to build a reuse system to provide irrigation for the golf course and other users, the cost for reuse water to Selva Marina country Club or its successors shall not exceed the estimated cost to operate the reuse system. Further, the rate for reuse water will be designed to equitably share the operating costs between all users of the reuse system now and in the future. For example, if other users are estimated to pay 50% of the operational costs then Selva Marina rate will be designed to pay the remaining. To meet the goal of a rate structure that encourages water conservation there shall be a minimum rate on the Golf Course irrigation usage of .002/1000 gallons. Further, during the first two years, as water use will fluctuate significantly, and plant and system will experience start up issues in operational expenses there shall be no rate fees. Basically, cupola is 42” 1 ½” above finish floor elevation or approximately 45’ above grade. According to TR, COAB should require a land use change to the clubhouse parcel to something other than residential as 35’ height limitation applies to residential use. Please “backdoor” a review. See what you can do. Cliff originally stated to send you 24X36 formatted sheets. The only problem is, the smaller the sheet, the smaller the elevation. Right now, the elevation is scaled at 3/16" = 1'-0".
