Ms. Durden,
I understand you are the City Attorney for the City of Atlantic Beach.
I represent an engineer involved in the renovation of a condo in
Atlantic Beach that is the subject of litigation. The Plaintiff has
noticed the deposition of the City’s Chief Building Official, Dan
Arlington. The litigation is styled Marshall Howell, et al., vs. The
Cloister of Atlantic Beach Condominium Association, Inc. et al., Case
No. 16-2019-CA-005019 and is pending in Duval County. I have attached a
copy of the depo notice for your reference. I have a few questions:
Was this date cleared with the City before it was noticed?
Did Plaintiffs serve Mr. Arlington with a subpoena, and, if so, do you
mind sending me a copy of it?
Is Mr. Arlington planning to attend the deposition as scheduled on
October 7?
Finally, I do intend to send a public records request to the City for
permitting and plan review related documents. Should I direct the
request to the City or to your office?
