RESOLUTION NO. PB - 99 - 12 = 01
A RESOLUTION OF THE CITY OF ATLANTIC BEACH,
GENERAL EMPLOYEES RETIREMENT SYSTEM,
AMENDING CHAPTER 2,ADMINISTRATION,ARTICLE VI,
EMPLOYEE BENEFITS, DIVISION 3, RETIREMENT
SYSTEM, RESOLVING THAT SECTION 175.361 OF THE
FLORIDA STATUTES SHALL BE FOLLOWED IN
TERMINATING ALL PAST, CURRENT AND FUTURE
ASSETS, LIABILITIES AND OBLIGATIONS OF THE
RETIREMENT SYSTEM RELATING TO FIREFIGHTERS;
PROVIDING THAT THE CITY OF JACKSONVILLE'S
POLICE&FIRE PENSION FUND SHALL BE SUBSTITUTED
IN THE PLACE OF SUCH TERMINATED FIREFIGHTER
PENSION PROVISIONS; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City of Atlantic Beach, Florida has entered into an agreement to
contract for Fire Services from the City of Jacksonville, Florida effective June 1, 1999; and
WHEREAS, the City of Atlantic Beach, Florida has agreed to transfer all Firefighters
and necessary retirement system assets, liabilities and obligations to the City of Jacksonville,
Florida; and
WHEREAS, the City of Jacksonville, Florida has accepted City of Atlantic Beach
Firefighters as members of the City of Jacksonville Police&Fire Pension Fund with full rights and
benefits in accordance with.Chapter 121 City of Jacksonville Ordinance code by enactment of
Ordinance 1999-472-E and in accordance with Resolutions 95-944-256 and 98-1006; and
WHEREAS, the City Commission of the City of Atlantic Beach has amended Chapter 2,
Administration,'Article VI, Division 3, Retirement System of the Code of Ordinances to terminate
all Firefighter related benefits; and
WHEREAS, the City of Atlantic Beach, Florida must comply with Chapter.175 of the
Florida Statutes when terminating it's Firefighter related Retirement System and designating the
City of Jacksonville Police&Fire Pension Fund as the substitute trust fund:
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE CITY OF ATLANTIC BEACH GENERAL EMPLOYEES RETIREMENT
SYSTEM, AS FOLLOWS:
Section 1. Firefighter related provisions of Chapter 2, Administration, Article VI,
Employee Benefits, Division 3, Retirement System shall be terminated in accordance with Florida
Statutes•§ 175:361 as amended.
Section 2. That the City of Jacksonville Police &Fire Pension Fund shall be substituted
as the Retirement System for the City of Atlantic Beach Firefighters effective 1 June 1999 in
accordance with Florida Statutes § 175.361 as amended.
Section 3. The provisions of this resolution shall take effect immediately upon its adoption.
