Re: Pedestrian bridge construction within West 14th Street right-of-way
Dear Mr. Nichols:
I write in reply to your inquiry concerning the p ossibility of constructing a pedestrian walkway over
the drainage swale that runs along and within the West 14th Street right-of-way. You have indicated
that your intent is to provide access from the Hidden Paradise recreation parcel (Tract A) to a dock
that you propose to construct, which will provide residents with use of the creek and marsh area.
You have requested permission from the City to use a portion of the right-of-way for this purpose prior
to initiating the State and Federal agency permitting process. My recommendation is that you provide
to the City a site plan depicting proposed construction including the bridge and dock and any other
structures. This can then be reviewed by the various City departments, and we will provide some
initial direction based upon that review. As you know, any authorization to use the right-of-way
would be subject to prior issuance of all FDEP and ACOE permits, as required. A binding provision
establishing continued access and maintenance of the drainage swale wo uld be required. A release
from any City liability would also be required, and the City would maintain all rights associated with
