319 12th Street Zoning Review Comments
1. Side Yard Setback: The northeast corner of the building encroaches into the 30 foot Building Restriction Line (BRL)
along Selva Marina Court. While the existing garage already encroaches into that BRL and is therefore a
nonconforming structure, we cannot allow a structure to become further nonconforming. There are a few options
available:
a. Redesign the structure so that no new construction is within the BRL
b. It is possible to grant an administrative variance of 5% of the restrictive code. In this case that would be
1 foot 6 inches. We would require a written request for the administrative variance, including evidence
that you meet at least one of the requirements of a normal variance and plans showing the actual
distance relative to the BRL.
c. If the administrative variance is not possible because the encroachment is greater than 1 foot 6 inches,
then you can seek a normal variance.
2. Overall Height: Please verify that the overall height to the peak of the roof is less than 35 feet.
3. Tree Removal: Please provide a Tree Removal Permit or an affidavit that no regulated trees will be removed during
construction. Both forms are available on the City’s website and at the Building Permits desk.
