Subject: Impervious Area Concerns re. 330 2nd Street
Dear Property Owner:
Duval County property tax records indicated that you are the owner of the followin g property in the City of
Atlantic Beach, Florida:
AKA: 328 Second Street (COAB Building Permit No. 03-25369)
Description: 5-69 16-2S-29E .07 Atlantic Beach E ½ Lot 7 Block 3
RE# 169761 0070
The purpose of this correspondence is to serve as an Official Request for Information. When permitted,
this property (Lots 7 & 9, Atlantic Beach Subdivision A) was ‘grandfathered’ to allow an impervious
surface area of 62.17% (As indicated in the February 12, 2002 letter from Sonya Doerr, the Community
Development Director to Doug Brown of The Construct Group at your address). The plans approved for
construction show the lot to be built to 60.54% (PW review documentation) impervious surface. Recently
a patio constructed of pavers has been added to the backyard of the townhome at 330 Second Street
without obtaining a building permit from the City. Please provide a survey, signed and sealed by a
licensed Professional Surveyor, showing the present impervious surface area of the designated property.
If claiming the 50% impervious credit for paver use, also provide a construction detail showing the method
of installation allows percolation through the paved surface.
You are hereby notified that unless the requested information is provided within 30 days from the date of
receipt of this notification, the City will obtain the requested survey. If the property is found to exceed the
permitted impervious surface, you will be billed for the cost of the survey plus a charge of 100% to cover
City administrative expenses. If not paid within 30 days after receipt of billing, the invoice amount plus
advertising costs will be posted as a lien on the property. In addition, you will be required to remove a
sufficient amount of impervious surface to bring the property in to compliance with the limits.
Within 15 days from this date hereof, you may make written request to the City Commission of Atlantic
Beach for a hearing before that body, for the purpose of showing that the above listed condition does not
constitute a violation of City Code.
