Dear Ms. Bradley:
The property you have inquired about is zoned Residential, Single-family (RS-2). Based upon the
survey you have provided, the lot contains a nonconforming single-story residence. (The residence
appears to comply with all minimum yard requirements, except on the east side, where only a 4’7” and
4’6” setback are provided, rather than the minimum required five-feet.) Subject to compliance with
applicable zoning regulations and Florida Building Code requirements, there is no prohibition against
increasing the height of the residence with a second and third-story addition up to the maximum 35-
foot height of building limitation.
The City’s Land Development Regulations authorize an administrative waiver of up to five percent of
the required standard. Unfortunately, in this case, that five percent waiver is not suffi cient to bring an
addition, which followed the vertical line of the existing east elevation of the residence, into
compliance with the minimum required five-foot side yard setback. Further, in order to comply with
Building Codes, it is likely that the five-foot distance from the property line would have to be
maintained in any event.
While a Variance request is an available process, it is not likely that staff could support such a request
in that there does not appear to be any type of hardship as defined by the zoning regulations. The lot
is a regularly shaped lot and is in fact considerably larger than the typical 50 -foot by 100-foot lot
within the City. Your client may wish to consider that if the vertical addition could be designed so
that the new construction provided the five-foot setback on the east side, a Variance would not be
required. I have enclosed a Variance application in the event that this option is preferred. Variance
requests are heard by the Community Development Board on the third Tuesday of each month, and the
filing deadline for the October meeting will be Monday, 5:00pm, September 30th. Please feel free to
