333 5th Street ZVL (Mary Jo Kilcullen) 06.12.2003 June 12, 2003 Mary Jo Kilcullen 333 Fifth Street Atlantic Beach, Florida 32233 Re: Additional construction at 333 Fifth Street, Lots 14 and 16, Block 7, within Atlantic Beach Subdivision “A” Dear Mrs. Kilcullen: As a follow-up to our earlier discussion, I have reviewed your survey and the additional construction you wish to perform on your property. Unfortunately, our current regulations would not permit the structure you have proposed without approval of a Variance, and I must frankly advise that I do not see “hardship” circumstances that could be used as justification for approval of a Variance, in that you have two lots, which appear to by typical of other lots within this area of the City. Nonetheless, you certainly have the right to make application to the Community Development Board for approval of a Variance. (As staff, I can only advise in accordance with the Land Development Regulations, but I can never predict what the Community Development Board will approve or deny.) I have enclosed a Variance application package. The filing deadline for the July meeting will be 5:00 pm, Monday, June 30th, and the July meeting will be held on Tuesday, July 15th at 7:00 pm. I will make you aware, however, that I have proposed revisions to our current zoning regulations, which if approved, would give some degree of relief to the constraints now applying to your property. The regulations now limit detached garages and storage structures to one-story in height, and these must meet all yard setbacks, which in the RS-2 Zoning District are 20-feet in the front and rear, and a combined 15-feet on the sides. (The only structures, which can be located as close as five feet from the property lines are storage buildings not more than 80 square feet in size.) I have proposed revisions, which would allow for two-story detached structures, which may be located closer to the property lines. These revisions will go the Community Development Board for discussion this coming Tuesday evening, and hopefully, to the City Commission for approval during August. You may wish to consider voicing your support for these changes either in written form or by attending the meetings where these will be discussed.
