Dear Steve:
I write in reply to your inquiry regarding t he division of the above referenced property into
two single -family residential lots. Section 24 -189 of the City’s subdivision regulations
provides an exemption from re -platting for a one -time lot division provided that both new lots
meet applicable size requirements. All new residential lots must have a minimum width of 75 -
feet at the Building Restriction Line, and 100 -feet of lot depth, resulting in a minimum lot size
of 7500 square. Based upon the survey you have faxed, this lot is of sufficient size to meet
these requirements, as well as those of the RS -1 Zoning District.
Please be mindful of two issues that would apply to future development upon the proposed
new lots: the existing residence would have to be demolished so that no nonconforming
struc tures were created on either of the two new lots; and secondly, Unit One of the Selva
Marina subdivision contains platted Building Restriction Lines, which are significantly greater
than the required zoning setbacks. Future development would be subject to those platted
Building Restriction Lines.
I believe that Section 24 -189 is fairly clear in explaining the procedure to create the lot
division. In summary, I will need at least three sealed copies of the survey depicting and
describing by legal descri ption the two new lots. (You may provide additional copies if you
need these for your files.) These will be certified as approved. Two copies will be returned to
you, and one will be retained in City files. At such time either lot changes ownership, a co py
of the survey approving the lot division must be recorded as an addendum to the new deeds.
