Dear Mr. Dupree:
At your request, I have conducted a preliminary zoning review of the residence proposed to be
constructed at 1632 Beach Avenue. I see from the information you have provided, that you have already
discussed the project with Public Works Director, Rick Carper. I want to preface my comments by
advising that my review is limited only to zoning compliance, and no review for compliance with
Florida Building Codes has been conducted. Final approval of drainage, stormwater and impervious
issues is under the authority of the Public Works Department, and will be reviewed for such at the time
the full permit application package is submitted to the City.
The only zoning issue I see that you may wish to verify is setbacks for several deck and mechanical
equipment locations. Once any deck exceeds 30-inches in height, it is subject to applicable setbacks.
The front (east side) stairs and deck, and the stairs on the north side of the garage appear as they may
encroach into the 20-foot front yard setback and the minimum 5-foot side setback. The breakfast room,
located at the northwest corner of the house appears to slightly encroach into the 20-foot rear yard
setback, but it also appears to be within the 5% administrative allowance of one-foot, which is
allowable. Finally, Section 24-83 (c) (reproduced below) requires mechanical equipment to be placed a
minimum of 5-feet from lot lines. The equipment along the north side of the residence does not meet
this requirement.
Sec. 24-83. Required Yards and Permitted Projections into Required Yards.
(c) Mechanical equipment. Equipment such as heating and air conditioning units, pumps,
compressors, or similar equipment that makes excessive noise, shall not be located closer
than five (5) feet from any Lot Line.
Also, several fences are depicted on the proposed plans. Please be aware that Fence Permits require a
separate permit application, which clearly depicts the location and height of all proposed fences. With
respect to any changes to current zoning regulations related to the Community Character project and
proposed residential development standards, this project would be vested to proceed in accordance with
the project as now designed, and not subject to such standards should these be enacted during coming
months, subject of course, to compliance with all other applicable Land Development Regulations and
building codes and further provided that the permitting for the project proceeds with a reasonable time
