Osborne 1632 Beach Avenue Atlantic Beach, Florida 32233 Re: Parcel Number 169549-0000 located at 1632 Beach Avenue Dear Mr. Osborne: I write in reply to your recent inquiry related to your property located a 1632 Beach Avenue, and land development regulations applicable to redevelopment of this property. This property consists of the southern portions of two platted lots (Lots 8 and 9) within Block 1, Unit 1 of Ocean Grove subdivision. The zoning designation of the property is RG-1, and the Comprehensive Plan land use designation is Residential, Medium Density. Based upon the information you have provided these two lots have been reconfigured in a manner that is not in accordance with the recorded plat. Section 24-188 (enclosed) of the City of Atlantic Beach Subdivision regulations addresses the re-subdivision of platted lots. In that no additional parcels are created and access points are not altered, a re-plat of these two lots is not required. Please be advised that the “new” lots must comply with the lot standards for the RG-1 Zoning District, which requires a minimum lot area of 5000 square feet and a minimum width of 50 feet and depth of 100 feet. While your property appears to comply with these requirements, I have some concern that the lot resulting from the residual northern portions of Lots 8 and 9 may not meet these requirements. (I am unable to verify the square footage of those portions of Lots 8 and 9 that are not included in your survey.) Section 24-47 of the Land Development Regulations allows for a five percent (5%) administrative Variance to certain standards, however, this waiver does not extend to required Lot Area. In other words, the two new lots resulting from the reconfiguration of Lots 8 and 9 must each contain 5000 square feet in order for both lots to be developed, or a Variance would have to be granted from the Community Development Board. Page two January 08, 2002 In regard to specific development requirements, I have enclosed a copy of the RG-1 standards. I noted that you have proposed a two-story detached garage located five feet from property line. Section 24-151 limits detached garages to twelve (12) feet in height and 600 square feet of Lot Area. Such structures must also comply with the minimum yard setbacks, which in the case of your lot are twenty (20) feet from the rear lot line and a minimum of five feet from side lot lines.
