COMMENTS: Alan, I have been talking with a Beach Avenue property owner (Charlie
Cromer) for almost a year about this property. We talked about this one a bit last year. The
prospective buyer at that time went away, so not sure it was ever resolved, but my question is
still the same. Will try to keep simple….
There were several variances granted about 10 years ago on the 50 x 50 lots on the west side of
the 1700 block of Beach Avenue. Mr. Cromer’s now owns two of these lots. He built his
current house on the northern of his two lots -- with a Variance. Another Variance (to
Townsend Hawkes, if that rings a bell) was approved in 1993 by the Commission on appeal,
for the adjoining lot Mr. Cromer now owns, but nothing was ever built on this lot.
George Worley gave Mr. Cromer a letter dated July 06, 1994 (attached) referencing a
conversation with you, and citing language in the motion that made the variance run with title.
Problem is, there is nothing in the motion in the minutes relating to the variance being
transferable and running with the title. The “old” code did not provide for Variances to be
transferable, and under current regulations, a Variance expires in 365 days if construction is
not commenced. Question is: Is the variance granted in 1994 still val id based upon George’s
letter referring to something that is not part of the minutes of record? (I tried to note the
relevant stuff.)
