Dear Mr. Grider:
I write in reply to your attached letter seeking to be vested under current City Land Development
Regulations for construction of the Coughlin residence at 1796 Beach Avenue as proposed,
designed and depicted on the plans submitted to the City on May 15, 2006, and in accordance with
the FDEP coastal construction permit, which you have advised is in process. As we discussed by
phone, the City has yet to adopt any changes to the Land Development Regulations, specifically
the proposed Residential Development Standards, from which you seek to be vested. While I
cannot find you vested from specific provisions of an ordinance that has not yet been adopted, I
can find that, based upon the design, engineering and FDEP permitting applications which have
been commenced as of this date, you are entitled to seek Building Permits and proceed with the
review and permitting process for the plans as referenced herein subject to compliance with
currently applicable City Land Development Regulations, Florida Building Codes and issuance of
a FDEP coastal construction permit.
Also, please bear in mind that, since an application for Building Permits has not yet been
submitted to the City, these plans have not been reviewed by other reviewing City Departments.
At the time an application for permits is submitted, plans will be routed to appropriate City
Departments in the customary process to verify compliance with all applicable regulations. I
would advise, after looking over the plans submitted with your letter, that you verify height
calculations to ensure that the Height of Building and the manner in which the Land Development
Regulations require height to be calculated, which is a Calculated Grade Average, can be
demonstrated. I have enclosed the definition of Calculated Grade Average. The east elevation of
the residence considerably exceeds 35-feet. I can assure you, that given the sensitivity of the
“height issue” in Atlantic Beach, we will be called upon to justify that the Height of Building is
based upon the Calculated Grade Average of the site. Please feel free to call me at 247 -5826 with
