Dear Mr. and Mrs. Pape:
I write in reply to your most recent letter dated February 04, 2002 regar ding your property at
1917 Beach Avenue. The parcel you own on the west side of Beach Avenue is considered a non-
conforming Lot of Record. While this lot does not meet the minimum size, width or depth
requirements for the RS-2 Zoning District, these lot have been considered as separate parcels
from their “counterpart” ocean front lots, and are entitled to the permitted uses that are set forth
within the RS-2 zoning district regulations.
Where these lots remain in joint ownership with the oceanfront parcels, Accessory Uses as
allowed by the zoning regulations are permitted to be developed on these lots, subject to
compliance with applicable site development criteria. In the case where these lots are no longer
in joint ownership with the ocean front lot, a Principal Use must first be established on the lot
before an Accessory Use is allowed. In other words, since you own the ocean front parcel, you
are allowed to build an Accessory Use on the parcel located on west side of Beach Avenue.
The practical obstacle to development of these parcels, of course, is that there small size makes
provision of the required setbacks very difficult without approval of a Variance. (A variance is
not required is setbacks can be met.) I have enclosed applicable provisions from the zoning
regulations. Please note, that a detached garage is limited only to twelve (12) feet in height. As
such, you could not construct a two-story combination garage and studio; however, both uses
would be permitted on the lot provided they are maintained within the 600 square feet, 12-foot
height limitation.
Within your letter, you also inquired regarding the amended zoning regulations. The regulations
were adopted in November, and became effective January 01, 2002. Please feel free to contact
