1917 Beach Avenue EmailMr. and Mrs. Pape: In reply to your letter of May 14, which I received by FAX, the one-year "grace period" you refer applies only to a narrow issue, and was not part of the amended zoning regulations. That provision was a special condition that applies only to the area of the core city that was rezoned from two-family to single-family. A one-year period of time was established (beginning November 26, 2001) during which property owners could proceed with plans to construct duplexes in that rezoned area. All provisions of the amended zoning and land development regulations became effective January 01, 2002. In order to construct a detached garage or accessory structure greater than 12 feet in height, a Variance would have to be approved by the Community Development Board. I have attached a Variance application. (The Community Development Board meets the third Tuesday of each month at 7:00pm. Applications must be filed by 5:00pm on the first Monday preceding that month's meeting.) The 12-foot height limit is not a new provision, although it was more clearly defined in the amended regulations. The previous zoning regulations limited accessory structures to "one-story in height." Generally, any development authorized as part of a variance must commence within one per below provision. (I) When a Variance is approved by the Community Development Board, the work to be performed pursuant to the Variance shall commence within 365 days from the date of approval unless otherwise authorized by the Community Development Board, or the Variance shall become null and void. The number of buildings allowed on single and two-family lots is set forth in the below provision. Sec. 24-82. General Restrictions upon Land, Buildings and Structures. (b) Number of Buildings allowed on a Single-family or Two-family (Duplex) Lot. The total number of Buildings on any Lot zoned only for Single-family or Two-family (Duplex) Use shall not exceed three (3) including the Principal Use Structure, detached garages and any other detached Building.
