Dear Mr. Dodd:
City records related to the above referenced Dutton Island Road property have been examined in response to
your request to build a single-family home on this parcel. This property is zoned RG-1. This Zoning
District requires minimum lot dimensions of 50-feet width by 100-feet depth, and a total minimum lot area
of 5,000 square feet to construct a single-family dwelling.
According to the City of Jacksonville Property Appraiser’s Office, the subject property has dimensions of
50-feet width, but only 60-feet depth, for a total of only 3,000 square feet. This lot does not meet the
minimum lot depth or minimum lot size requirements for this or any other residential Zoning District within
the City of Atlantic Beach.
The zoning regulations recognize that some legally established lots of record may exist that do not meet the
above requirements, and provisions have been made for development of such lots. We have been unable,
however, to determine that this is a legally established lot that met zoning requirements when it was created,
and therefore, I cannot administratively deem this property to be a legally established Lot of Record for the
purpose of obtaining Building Permits. The Warranty Deed documenting a prior land transaction
demonstrates only that Gerald Sohn donated this land to Triumphic Apostolic Faith Church in 1986. Your
ownership is not reflected by current Property Appraiser’s on-line records. It was my understanding that you
purchased this property from the church with their representation that it was a buildable parcel. Please bear
in mind that the assignment of a Property Appraiser’s Real Estate (RE#) number is for property tax purposes
only, and does not establish the property as a legal lot of record.
I am unable to make a determination that the subject property is buildable in accordance with City’s Land
Development Regulations because of its substandard depth and size. If you discover evidence of this
property as a legally established lot, which typically would require it to be a parcel created prior to the
existence of any zoning regulations, I can reassess my findings. Otherwise, the only recourse that you have
is to seek a Waiver of the Land Development Regulations from the City Commission. I have enclosed the
appropriate application form.
