Re: Property within Donner’s replat subdivision (RE No. 172198-0100)
Dear Mr. Gipson:
I have reviewed City files for information about this property, and there is little file history related
to this property. It appears that this parcel was created in December of 1986.
This 50-foot wide by 60-foot deep parcel is not considered to be a Lot of Record in that is has been
illegally divided from the “parent” parcels, which were Lots 3 and 11 of Block 1 of the Donner’s
Subdivision re-plat. The City’s Zoning regulations have always required a minimum residential lot
depth of 100-feet. In its current configuration, the parcel is not a buildable lot in that it is a
nonconforming lot and an illegally created lot. In order for the lot to be considered a
nonconforming, – but legal – Lot of Record, it would have to have been created before the City’s
first zoning regulations were established in 1959.
The only way you could build on this lot would be for the City Commission to grant a Subdivision
Waiver allowing development of a lot that does not meet the size, width and depth requirements
that have been in effect for many years. I must advise that I do not believe that it is likely that the
City Commission would approve such a request.
