While the CBD regulations are in place, the zoning map change has not yet been made, but this will be completed within the coming month. As such, the CBD regulations should be used in development planning for the property. As we have discussed, residential use, where such residential use is secondary to the commercial use of the Building may be approved as a Use- by-Exception within the CBD. Any commercial use would be limited to those permitted uses as set forth within Section 24-114 (b) of the Land Development Regulations. While the dwelling combined with office use you have generally described seems consistent with the CBD, the setbacks as depicted on you conceptual site plan do not meet the CBD yard requirements. In that this lot is a corner lot, a minimum 15-foot setback is required on the Pine Street side. A 10-foot setback would be required on the opposite side. The front and rear setbacks are 20-feet and 10-feet, respectively. Approval of a Variance would be required for development as depicted on the proposed site plan. (I would caution that there is not an apparent hardship associated with this lot.) The four proposed parking spaces are sufficient for the use and size of the project; however, if the building is to be used for any commercial purpose, one space will be required to be ADAAG compliant, and the minimum 10-foot by 20- foot dimension size would be required for other spaces.
