Re: Denial of application for pool permit at 2348 Seminole Reach Drive
Dear Mr. Mauer:
Enclosed I have returned a copy of a permit and a site plan for a pool located at 675 Beach
Avenue, which you delivered last week for my review. You indicated that you believed permits
were issued to construct this pool three feet from the property line. My review of files related to
this project, and the property survey, verifies that this six-foot deep pool was in fact properly
permitted, and the pool is located the required minimum distance of six feet from the property
line. The pool plan depicts a three foot separation from a planter wall, which is not located on
the property line.
Chapter 24-164 requires that all pools be located a minimum of five (5) feet from any Lot Line.
The previous regulations required that one foot of depth be maintained for each foot of depth of
the pool. The proposed pool ranges in depth from three (3) feet to five (5) feet. Accordingly,
under the regulations in effect prior to January 01, 2002, the required distance from the property
line was five (5) feet. This language was amended during recent revisions to the zoning
regulations to simply state that all pools must be located a minimum of five (5) feet from any Lot
Line.
