In response to your zoning compliance letter request, staff has drafted the following.
The property 363 Atlantic Boulevard is located in the Central Business District (CBD) zoning
district. Regulations for the CBD zoning district are attached to this letter.
Information on current violations including open cases and any liens against the property are
provided in lien letters provided by the City Clerkâs office. You can contact Dayn a Williams at
(904) 247-5810 or dwilliams@coab.us for more information on how to obtain a lien letter.
Historical data on closed cases can be made available though there may be costs associated
depending on delivery method chosen. Please let me know if you would like us to research that
information for you and we will provide a cost estimate.
Research of our records did not produce calculations for the parking at the time of construction of
the shopping center and restaurant. It does appear that parking calculations were historically based
on the restaurant building being a separate use from the shopping center despite it not being on a
dedicated outparcel. Utilizing this technique shows the shopping center to be under parked. When
utilizing a calculation based solely on square footage as a shopping center, the property is over
parked. Ultimately, the parking is grandfathered in as a legal nonconformity under its current
configuration and would only be subject to current regulations if it is altered. This could be a
significant issue as the parking along the north side of the property on Ahern Street is
nonconforming and could not be rebuilt.
