Re: Application for Occupational License
Dear Mr. Latiff:
Your application for an Occupational License to operate a business by the name o f
“Fantasy Lane” at 615 Atlantic Boulevard has been forwarded to the Planning and Zoning
Department. (All applications for Occupational Licenses within the City of Atlantic
Beach require zoning approval.) The form is not complete in that the section requ iring
that the applicant “explain fully the nature of the business” provides only a limited
description of the proposed business and products sold.
I have been unable to reach you by phone today, but the City must have sufficient
information to determin e that the proposed business is not an Adult Entertainment
Establishment as defined by Section 847.001 (2), Florida Statutes. This use is not a
Permitted Use within the City’s Commercial General Zoning District. Further, the
subject location at 615 Atlan tic Boulevard is less than 2,500 feet from a public
elementary school, Atlantic Beach Elementary. Section 847.0134, Florida Statutes
prohibits the location of certain such establishments within 2500 feet of a public
elementary school. Accordingly, the Ci ty cannot approve your application for an
Occupational License without additional information. If there is some misunderstanding,
and the proposed business sells no products that fall within the definition of Section
847.001 (2), Florida Statutes, please provide such in writing on your application and re -
