Dear Mr. Latiff:
As suggested in your October 27, 2003 letter, the City has investigated the four other Fantasy Lane
locations within the area. Upon receipt of information and evidence provided by the City’s Police
Department, specifically DVDs sold at each business, the City finds such materials to be included within
the definition of “Adult bookstore,” which is an “ Adult Entertainment Establishment” as defined by
Section 847.001 (2) (a) Florida Statutes and as addressed by the prohibitions set forth within Section
847.0133. You have indicated within your letter that the proposed location would be similar to other
Fantasy Lane locations; therefore, it is reasonable of the City to assume that similar materials would be
sold at 615 Atlantic Boulevard. The City finds that such establishment would violate Section 847.0134,
Florida Statutes, in that the proposed location at 615 Atlantic Boulevard is less than 2500 feet from a
public elementary school, Atlantic Beach Elementary. Further, the distribution and display of such
materials is in violation of the Section 13-6 of the Code of Ordinances for the City of Atlantic Beach.
Accordingly, approval of a local occupational license to operate said business within the Commercial
General Zoning District on property located at 615 Atlantic Boulevard is denied.
In accordance with Section 24-50 of the City’s Code of Ordinances, this decision may be appealed to the
Community Development Board. Any such appeal shall be filed in writing with the City Clerk within
thirty (30) days of the date of this letter.
