Re: Expansion of automotive repair business
Dear Mr. Essick:
I write as a follow -up to our meeting of several weeks ago. I need to corr ect
information I provided to you regarding expansion of your existing business. I believe
that I advised you that expansion of your auto repair business to add work bays under
the existing fuel pump canopy would not require approval of a Use -by-Exception. If
expansion would result in more than the same number of work bays that now exist,
approval of a Use -by-Exception would in fact be required.
In December of last year, the City enacted certain revisions to the zoning regulations
related to Automotive R epair businesses. The existing Texaco station and your
business are considered to be an Automotive Service Station with Minor Automotive
Repair, which is a by-right permitted use within the CG Districts. I have enclosed a
copy of the applicable definitio ns and provisions from the City’s Land Development
Regulations. The changes to the City’s regulations now define automotive repair
facilities with more than two work bays as Heavy Automotive Repair, which requires
approval of a Use -by-Exception in the CG District. In that the existing auto repair
business, which has three work bays, existed prior to revision of the definition, the City
recognizes the existing auto repair business, with three work bays, as a legal and vested
use of the property. Any expan sion of the automotive repair business that results in
more than three work bays for the entire site, however, would require approval of a
