RE: 535 Royal Palms Drive
Thank you for providing a revised survey for 535 Royal Palms Drive (Lot 12, Block 9, Royal
Palms-Unit Two.)
The single-family residence located on this lot was constructed in 1986 (Permit No. 7970
issued August 22, 1986.) As you have observed, the existing residence encroaches slightly
on the 25-foot platted Building Restriction Line on the north side of the lot. All zoning
setbacks are provided. This structure is deemed a lawfully permitted and constructed
structure, such that it would be replaceable in the existing footprint.
At the time that Royal Palms was platted and developed, the City typically relied on simple
“plot plans” for the purpose of permit issuance, and surveys were not required until
construction was completed. This minor encroachment beyond the platted BRL is not
entirely uncommon in older subdivisions, and I would assume is the unintentional result of
surveying and construction practices that were less accurate at that time. Again, the City
does not consider this to be a Nonconforming Structure as such is defined by the Land
