RE: Certificate of Occupancy for commercial project 1701 Mayport Road
COMMENTS: I have reviewed the As-built survey and installed landscaping for issuance
of the Certificate of Occupancy for the above referenced project. The chain -link fence, which
has been installed along the rear and sides of the retention area adjacent to the residential uses,
does not comply with the approved landscape plans or with Section 24-167 of the Land
Development Regulations.
If it is your desire to maintain the chain-link fence, a landscape buffer that meets the underlined
provisions of Section 24-167 must be installed. (You may wish to consider using a larger size
of viburnum placed between the installed river birch, and on the exterior side of the chain-link
fence, or other hedge type of shrub that will form a continuous evergreen buffer.)
Please be advised that the buffering requirements must be met prior to Planning and Zoning
Department approval for issuance of the final CO. Following are the applicable provisions of
the Land Development Regulations, which address this issue.

Sec. 24-167. Required Buffering Between Residential and Non-Residential Uses.
When Development is proposed in any non-residential Zoning District that adjoins a Lot in
Residential Use, either to the side or to the rear, buffers as described below shall be provided.
(a) Where non-residential Development is proposed adjacent to residential development, there
shall be a solid masonry wall, or wood fence, shrubbery or Landscaping as approved by the
designated Administrative Official, along Required Rear and Required Side Yards. Such
buffer shall be a minimum of five (5) feet in height , except that within Required Front
Yards, such buffer shall be four (4) feet in height. Required buffers shall be constructed
and maintained along the entire length of the adjoining Lot Line.
(b) Where Landscaping is used as the required buffer, such Landscaping shall provide one-
hundred (100) percent opacity within twelve (12) months of installation.
(c) Where a wall or fence is used, such wall or fence shall be constructed on the non-
residential property, and height of the wall or fence shall be measured from the Finished
Grade of the non-residential property, whether filled or not. However, in no case shall a
wall exceed eight (8) feet in height as measured from the lowest side. Buffer walls and
fences as required by this Section may be constructed to a maximum height of eight (8)
feet, subject to approval of the designated Administrative Official upon demonstration that
such height is required to provide adequate buffering between Uses.
