RE: 1795 Mayport Road (Parcel Number 172056-0000)
I respond to your attached letter of April 14, 2003 regarding the existing residence
at 1795 Mayport Road. While the existing residential use is in fact nonconforming
to the Commercial General Zoning District designation, the current owner or any
successor in ownership is permitted to maintain the residential use of this lot,
subject of course, to all applicable Florida Building Code requirements and other
local Land Development Regulations, and further provided that the residential use
is not discontinued for a period of six (6) months or longer. The City has
recognized the inconsistency between this zoning district designation and the
historical use of the E. H. Donner’s subdivision, and considers these to be vested
lots of record entitled to be maintained as residential. I would also advise, that it is
the City’s intention to correct this inconsistency within the coming year, following
amendments to our Comprehensive Plan.
