Gladiola & West Plaza (Keith Schackman) 06.04.2004 June 04, 2004 Keith Schackman 400 Sandiron Court, Unit No. 412 Ponte Vedra Beach, Florida 32082 Re: Property located south of Gladiola Street and West Plaza Dear Mr. Schackman: Your property, as depicted on the attached survey, is within the RS -2 (single-family) Zoning District and the Residential, Low Density Comprehensive Plan land use category. The RS -2 district requires a minimum lot size of 7,500 for all new lots, and the Low Density designation allows a maximum of six dwelling unit s per upland acre of land, which is approximately 7200 square feet of lot area per dwelling. Development of this land would be somewhat constrained because of its unique and environmentally sensitive location. I have attempted below to address the spec ific questions within you letter.  The zoning variance procedure cannot be use to reduce required lot width or size. The only procedure available to address this issue would be approval by the City Commission of a Subdivision Waiver. Further, in the even t that the Commission approved a waiver to allow for the creation of a three -lot subdivision, the preparation and recording of a Final Subdivision Plat would be required. All new Subdivisions are required to provide central water and sewer. Provision for a shared private driveway would also be required. I have enclosed (and highlighted) copies of the applicable regulations.  The City would not consider deeding the 30 -foot easement to your partnership. As noted on your survey, this is a drainage and mars h access easement. It is not in the City’s interest to abandon any drainage easement, and the City’s Comprehensive Plan contains provisions that prohibit the closure of any beach or waterway access easement. page two, Mr. Schackman June 04, 2004  Lastly, it is the City’s long -term objective t hat all development areas be served by central sewer and water services, but there are no immediate plans for the City to extend these services within this area. It will remain the developer or property owner’s responsibility to extend lines as required b y the Land Development Regulations. You may wish to contact the City’s Utility Department at 247 -5834 to determine the exact location of the nearest services. I have enclosed numerous provisions from the Land Development Regulations that would be applicable to development of this land in the event that a Subdivision Waiver and a new Subdivision were to be approved.
