Gladiola Street & West Plaza (Keith Schackman) 06.22.2004 June 22, 2004 Keith Schackman 400 Sandiron Court, Unit No. 412 Ponte Vedra Beach, Florida 32082 Re: Property located south of Gladiola Street and West Plaza Dear Mr. Schackman: The division of this property into two one -acre lots – rather than three lots – would be generally consistent with the City’s subdivision regulations and the Low Density Comprehensive Plan designation. A division into two lots would also be exempt from the requirement for platting, provided that the new lots meet ot her applicable regulations. I have attached Section 24 -189 of the Land Development Regulations. Subsection (a) (4) explains the process to have the new lots approved and recognized as legal lots. The City will first require a copy of the deeds for the property. As you may know, there is a rather long history with this property involving the closure of Gladiola Street and the exchange of land that is the drainage easement on the April 2000 survey. I have attached some information from City records rel ated to this. My concern after reading through the minutes of City Commission meetings is the reference to allowing only one single -family residence to be constructed on the property. The motion approving the street closure is somewhat vague, and I canno t determine whether that limitation was intended to apply to only the former right -of-way or to the entire property formerly owned by Mr. Martin. I will consult with the City Attorney, and the current deeds should contain any restrictions that apply to th e property. Provided there is no conflict with any deed restrictions related to the City’s closure of the street, I would then need at least three sealed copies a current boundary survey of the property depicting each new lot with a legal description fo r each lot. When approved, these will be returned to you, and one copy will be maintained in City records. With respect to access and water/sewer services, West Plaza will have to be improved to City standards to provide paved access to each new lot. You will need to contact the City’s Utility Department at 247 -5834 to determine the exact location of the nearest water and sewer services, and to determine if existing lines are in proximity such that these page two, Mr. Schackman June 22, 2004 must be provided for new development.
