Kathy-
We discussed the "condominium hotel" issue with the Remington group at a meeting about a week ago. While a condominium form of ownership of individual guest units is not prohibited in
any manner by City regulations, full-time owner occupancy would not be permitted as this would render it a residential use rather than commercial hotel/motel use. Conversion to a residential
use would be expressely prohibited since this site is within the Coastal High Hazard Area. (Our Comp Plan provides for Medium Density residential use within the Commercial land use
category, provided that the property is not located within the CHHA.)
Our Land Development Regulations define residential occupancy as longer than 90 days. Anything less is a commercial "short-term rental" use. As such, an owner or lessee could not occupy
any unit for a period of time longer than 90 days.
Also, the units could not be equipped with a full kitchen, but could contain a "kitchenette" defined as:
Kitchenette shall mean an area within a Building containing limited Kitchen facilities such as a bar sink, microwave oven, refrigerator/freezer not exceeding ten (10) cubic feet.
The Remington representatives discussed their need to probably have a bit more in the way of cooking facilities than a microwave. This possibly could be stipulated in the City Commission's
approval that is required for the second tower, but kitchen facilities would still have to "limited" in such a manner so as to be consistent with the intent not to create a full residential
Dwelling Unit.
I have not yet a chance to do more than skim-over the information from other jurisdictions that Rob Haiman provide to us, but I will this week.
Regarding the need for a FLUM amendment, our position would be that the parking lot use on the north parcel would be vested accessory use (per Comp Plan) and subject to the appropriate
zoning change and other current building and LDRs, a parking structure would be a permitted use. In any event, I do not believe the City would be inclined to change the FLUM designation
until the parking structure construction was "certain." (As is, the property consists of six platted residential lots.)
Again, we would likely include this as an administrative FLUM change when we get to the EAR-based amendment process late this year, if the plans for the parking structure have continued
to progress by that time such that this would be appropriate.

Thanks so much for your quick response.
As to your response to Item 3 below, is there any information and/or exhibits, etc. we can provide that would assist in your determination that a FLUM Amendment is not required?
We would also like to clarify that the proposed additional tower is a "condominium hotel" whereby the hotel rooms/units are owned by individuals who may or may not enter into rental
agreements with the hotel management to subject their hotel rooms/units to rental to the public. Please confirm that the foregoing still conforms to the permitted use as a hotel in
CG/Use by Exception. Please also advise if owner occupancy of the hotel room is permitted and if there are any restrictions on the length of occupancy by the owner. While we hope
to discourage owner occupancy, we need to know the City's restrictions.

on the property would fall within the legal non-conforming use or if we would be required to obtain a zoning exception for the new construction.
A zoning exception is not required for the new tower, but approval by the City Commission of the additional tower with respect to design, and verification of consistency with the special
provision that was included within the City Charter height limitation is required.
2. Is there any requirement by the City of Atlantic Beach to provide first floor retail in a parking garage?
No. But we will be looking for an appropriate design at street level.
3. The parcel currently used for ground parking (RE 170217-0000) at the northeast corner of Ahern Street and Ocean Boulevard is zoned RG-2 with a land use classification of RM.
Pursuant to our conversation, the current use as an off-site parking lot is a legal non-conforming use. Please advise: (a) if there is a zoning district within the RM land use classification
which permits a parking garage and therefore would not require a land use amendment; and (b) if not, please confirm that we would be required to rezone the property to CG, obtain a
zoning exception and a land use amendment prior to constructing a parking garage, and the maximum height of the parking garage would be 35'.
A change in Zoning to Commercial General along with a Use-by-Exception for the Parking Structure will be required, and I could construe that a FLUM amendment is not required. However,
this could be done as small scale amendment, and I think wood be a simple one that could run with the rezoning. It would be a reduction to Density in the CHHA, so not likely to trigger
any DCA review. If not done as part of this process, we would probably do it administratively as part of our EAR-based amendments.
...and yes the parking garage will be limited to 35' height.

The exception given to certain parts of the Sea Turtle Inn, located at 1 Ocean Blvd are noted. As stated, the exception applies only to parcel #170229 0000 (hotel) and does not include
parcel 170217 0000 (parking lot). As for the hotel parcel, the exception applies only to expansions of the existing structure within a given area, as shown on map below. The green
shaded area is the only area subject to the exception, and this is an approximation on my part.
