Dear Mrs. Gindlesperger:
As we have discussed, in November of 2001, the City included a provision in our Land
Development Regulations, which allows lawfully constructed duplexes, that were existing as of that
date, to be reconstructed within their existing building footprint or in compliance with applicable
setbacks for the particular Zoning District in which they are located. After consulting with the City
Attorney, it is the City’s position that allowing a Two-family Dwelling (duplex) to be reconstructed
on this lot would be consistent with the intent of that provision, even though the property currently
contains a three-unit dwelling. I have attached a copy of the referenced provisions. As such, a Two-
family Dwelling (duplex) may be reconstructed on this lot in accordance with the terms of Sections
24-86 and 24-87, and subject to other applicable regulations and Florida Building Code
requirements.
