Re: 1765 Beach Avenue I Minor Dimensional Variance for Poolside Restroom Enclosure
Dear Mr. Blasingame:
I am writing as follow-up to our discussion earlier this morning regarding the proposed addition of an
enclosed restroom to an existing detached accessory structure on the property located at 1765 Beach
Avenue. According to construction plans submitted to the Building Department for permit (#08-697) and
stamped as approved/compliant with zoning regulations by then -Community Development Director
Sonya Doerr on May 20, 2008, the accessory currently consists of a summer kitchen with a solid roof
structure and four (4) supporting columns but no walls. The southernmost supporting column is located
approximately thirty-six (36) inches from the southern property line.
The property owners have expressed a desire to add a small enclosure including toilet facilities to serve
the outdoor amenities. The proposed location of the restroom would be northwest of the southernmost
supporting column, under the existing roof structure. Per section 24-151(b)(1) of the land development
regulations, such an enclosed accessory structure requires a minimum five (5) foot side yard setback. Per
section 24-47(h), staff has the ability to grant an administrative minor dimensional variance of up to five
(5) percent of the required standard, or three (3) inches in this case, thereby reducing the required setback
to four (4) feet, nine (9) inches, and such an administrative minor dimensional variance is hereby granted.
If, however, an encroachment is anticipated to be greater than three (3) inches, you would need to apply
for a standard variance, which requires review and public hearing before the Community Development
Board, as described in section 24-64 (attached).
To summarize, the required side yard (south) for the enclosed restroom portion of the detached
accessory shall be four (4) feet, nine (9) inches. Also be aware that the project must commence and
building permits must be issued within one year of this date, or the terms of this administrative variance
shall expire. Please submit a copy of this letter along with any application for building permits, and feel
