COMMENTS: Mrs. Pape, the parcel you have inquired about is a single corner
Lot of Record within the RG-1 Zoning District containing a two-unit dwelling.
For purposes determining applicable setbacks, the lot is considered in its entirety,
and not as two 50-foot by 50-foot lots. The 17th Street side of Lot 10 is the Front
Yard, requiring a twenty (20) foot setback, and the opposite (south) side of Lot
10 is the Rear Yard, also requiring a twenty (20) foot setback. The Beach
Avenue side is the Side Yard, and a fifteen (15) foot setback is required for all
construction that exceeds thirty (30) inches in height along this side of the lot. A
minimum five (5) feet setback is required along the west side of the lot.
I would also advise that the fifty percent (50%) maximum permitted Impervious
Surface Area applies to the entire lot, and while I can not be certain from general
observation, it looks as if development on the lot may already exceed that limit,
in which case no additional development would be permitted even if required
setbacks could be met.
