Beach Avenue (Dale Whitaker)Van - I cannot imagine that the CD Board would approve a Variance for a garage addition, or a detached garage, on the northwest side of this lot. It would be inconsistent with any such approval/denial I have recently seen by the CD Board, and in conflict with very deliberate change made in the regulations in November of 2001 requiring structures to be further from Beach Avenue right-of-way. Nonetheless, it is certainly within the property owner's discretion to make such application. (The deadline for the October meeting will be Monday, October 6th at 5:00pm.) One thing you may wish to consider, I have proposed some changes that may impact detached garages, if adopted. I have proposed that one-story detached garages (limit of 600 sq. feet in size still applies) be permitted to be located a minimum of 10-feet from rear lot lines -- rather than 20-feet. (Beach Ave side is the rear on oceanfront lots) ....but keep in mind that any structure connected by a solid roof is considered a part of the main structure and would therefore be subject to the 20-foot rear yard setback from Beach Avenue, even with the changes I have proposed.
